Review Examiner II - Hearings
Duties: In accordance with 458 CMR and M.G.L. Chapter 175M and 458 CMR 2.00, conducts administrative hearings in accordance with procedures prescribed by M.G.L. Chapter 30A and 801 CMR 02. Elicit sufficient evidence and testimony to resolve all issues, including those highly complex issues, on agency determinations regarding benefits, subjectivity, charges and penalties. Writes clear and concise decisions, which contain findings of facts sufficient to support the ultimate findings and conclusion of law, which comply with statutory provisions, case law, and agency policy. Produces accurate written decisions verifying and ensuring proper form and conformance with data and procedures. Uploads and data enters decisions into online system within a timely manner that is reasonable and attains the guidelines for promptness. Reviews material to determine compliance with applicable laws, rules, regulations, and procedures; take appropriate action to resolve problems. Review cases prior to and after the hearing to resolve any questions, obtain needed evidence/information necessary to dispose of pending appeals, or consult with agency staff to resolve problem; provides guidance to employees of lower title on same. Resolve appeals prior to hearing by analyzing data obtained from investigations and applying relevant laws, rules, regulations, and precedents to formulate legal conclusions concerning eligibility for benefits in dispute. Works closely with management, provides on-the-job training, mentoring, or interdepartmental training on matters involving Hearings. Investigates appeal issues sent to hearings by conducting fact-finding interviews by telephone to gather information from claimants and may require additional investigation into employer data. Create and preserve oral and written records of proceedings for use in further study or appeal of case. Performs all job duties in a manner to enhance the agency’s achievement of its customer service and operational goals. Review/Approve draft decisions of Review Examiner Is for accuracy, completeness of content, and findings. Supervise, assign work to, and review performance of employees of a lower title. Prepare case management reports. Perform other related work as required.

Qualification and Experience

Qualifications: Member in good standing of the Massachusetts Bar. Fluency in a non-English language. Must have (A) 4 years of full-time, or equivalent part-time, professional experience, the major duties of which included the adjudication, examination and/or review of claims, benefits and/or taxes; the practice of law; labor relations work; claims investigation or adjustment work; credit management or credit investigation work; or (B) any equivalent combination of the required experience and the substitutions below.
I. A Bachelor’s or higher degree with a major in law may be substituted for 3+ years of the required experience.
II. A Bachelor’s or higher degree with a major other than in law may be substituted for 2+ years of the required experience.
Education toward such a degree will be prorated on the basis of the proportion of the requirements actually completed.
NOTE: Educational substitutions will only be permitted for a maximum of three years of the required experience.
