Litigation - General (consumer)

Trial Attorney II The candidate provides legal representation for clients in matters of moderate complexity and/or risk, with limited supervision. Reviews and evaluates assigned cases. Prepares and tries cases in all courts and agencies. Communicates with Claims and clients. Provides related legal advice and services. Reports to Managing Trial Attorney. With moderate supervision, works on legal matters that of basic or moderate complexity and/or risk, representing clients in trials or hearings before courts or agencies, including appeals and arbitrations. Reviews and evaluates cases and lawsuits in accordance with established NTD Best Practices guidelines. Developing proficiency interpreting insurance contracts and coverage issues: knowledge of state and local practices and rules, state and local practices and rules. Gathers relevant information, conducts research; evaluates reliability of case, witnesses and information. Works with client and claims to establish, communicate and implement Litigation Plan. Keeps client and claims professionals fully informed. Has contact with Claims management. Prepares and tries cases of above average complexity and moderate exposure (including injuries) in all courts and agencies. Recognizes, participates and promotes settlement opportunities. Negotiates as authorized within adjuster's authority. Takes depositions of parties and experts; obtains meaningful discovery and participates in motions practice as warranted. Performs other duties as assigned.
Qualification and Experience
The candidate should have JD Degree from an accredited law school. Must be currently licensed as an attorney in an appropriate U.S. jurisdiction. Maintains an active license in the state in which the position is located. Typically have 3-8 years of relevant civil litigation experience. Should have experience in one or more areas of trial law. Must have knowledge of applicable legal practices and procedures. Substantive civil law, insurance contracts knowledge. Adherence to Private Practice of Law policy. Should have excellent written and verbal communication skills and ability to negotiate. Must have ability to process information efficiently and effectively. Excellent analytical and legal skills. Should have good time management and organization skills for contacts with all levels of management and clients. Decision-making ability to set work priorities. Strong legal research techniques.
