Senior Counsel Responsibilities: Assist in and conduct the initial factual investigation and analysis of pertinent documents for early case evaluation, including the review and analysis of all relevant information pertaining to facts, jurisdiction, vehicle service records, expert reports, emergency responder reports, accident photographs, vehicle reconstructions, employee files, employee communications, investigation reports, applicable case law and statutes and opposing counsel to determine settlement potential and value. Supervise the early assessment and cost-effective handling of product liability, business, consumer and employment disputes, including determination of settlement, retention of outside counsel, or in-house defense. In cases requiring early settlement, aggressive negotiation of resolution. Evaluate and respond to requests from HMA dealerships for defense and indemnification. Review Preliminary Investigation Reports/Legal Consumer Affairs Action Requests initial information packets from customers alleging product defects resulting in injuries/property damage, determine whether inspection of vehicle is warranted, review inspection findings, consults with HMA engineer and issues final recommendation to Consumer Affairs. Supervise staff in the strategic direction and efficient management of cases after initial case evaluation; coordinate with outside counsel to develop and implement appropriate legal and procedural strategies. Prepare and direct the preparation of detailed draft responses to discovery requests including interrogatories, requests for production of documents, and requests for admissions. Coordinate the preparation of final responses with outside counsel. Work with Hyundai Motor Company to obtain all relevant documents to ensure compliance with all discovery obligations. Work with outside counsel, outside experts, engineers, and legal department management to appropriately evaluate cases and, where appropriate, request settlement authority (via a Request for Settlement Authority) form executive management and Hyundai Motor Company. Attend and represent HMA at settlement conferences, mediations, arbitrations, jury research, oral arguments, trials, and scene and vehicle inspections. Authority: ~ Actively manage consumer, product liability and employment cases for Hyundai Motor America, Hyundai Motor Company and, where appropriate, other affiliates (HMMA, HATCI). ~ Manage vendors including outside law firms and expert witnesses/consultants. ~ Conduct thorough investigation and evaluation and decide litigation and defense strategy, case value and whether to settle or try individual cases in conjunction with management and Hyundai Motor Company. ~ Support various HMA departments, primarily the Service department and Consumer Affairs, in addressing customer product defect allegations and potential class action risks. ~ Support Human Resources in investigating, evaluating, and addressing employment issues including employee counseling, corrective actions, terminations, severances, morale issues and litigation risks. ~ May be involved with interviewing/evaluation of new hires.
Qualification and Experience
Qualifications: Bachelor’s degree required. Master’s degree a plus. JD Degree required. Member California State Bar Association. Large law firm experience preferred. 10+ years' directly related experience in litigation, including automotive-related matters. 5-7 years of supervisory experience desired. Strong organizational skills. Strong legal and factual analytical abilities. Excellent written and verbal communication. Comfortable with aggressive and proactive defense strategies. Strong drafting and negotiating skills. Ability to work quickly and independently.
