Right-Of-Way Legal Specialist Duties: Negotiates right of way permits and easements for the new railway. Perform examination of legal titles, surveys or legal property descriptions as recorded at the register of deeds office. Analyze the new alignment route to determine legal property ownership. Work with property owners, public agency staff and the public in explaining right of way activities. Assist in the negotiation of terms and compensation for acquisition. Work entails the use of independent judgment and the application of knowledge gained through education, professional training and experience regarding real estate titles, and the acquisition of property easements. Conducts negotiations with property owners for the acquisition of rights of way, easements, construction easements, and other interests in real property for the new railway. Prepare and review easement documents. Assist with the condemnation process where necessary, and prepare legal documents for inclusion in condemnation packages submitted to court. Conduct or direct the recordation of legal documents for property easement acquisitions, and prepare and maintain records of property easements for right of way. Assists in preparing reports for weekly construction project status meetings and reports on the status of right of way acquisition.
Qualification and Experience
Requirements: Bachelorâ€™s degree in a relevant discipline, with a preference for engineering, business, or law, with a P.E. or JD Degree preferred. 10+ years of legal experience, preferably on large infrastructure projects. Experience drafting and negotiating agreements. Excellent writing and communication skills.
