Litigation - General (consumer)

General Counsel Duties : Represents the agency’s position and statutory obligations in legal matters, obtains information on cases for hearings, advises agency staff on legal matters, prepares administrative and legal documents, interfaces with the General Counsel and legal staff at the Executive Office of Public Safety and Security and works as the agency's public records officer. Provides legal counsel to the Chief Medical Examiner and all agency staff relative to the proper interpretation and implementation of G.L. c. 38 and all related administrative regulations and administrative or judicial orders and decisions. Represents the agency staff in judicial and administrative forums relative to all legal matters. Prepares materials and presents issues to the Chief on an as needed basis. Engages in litigation in several administrative forums, and all levels of the courts of the Commonwealth. Participates in agency policy development process. Serves as a liaison with the Attorney General’s office on litigation in which the Chief or any staff member is a party. Reviews and interprets pending legislation and language in budget documents that may impact the OCME and may draft legislation to further the OCME’s legislative agenda. Maintains familiarity with all OCME related legislation, regulations, and judicial and administrative decisions, in Massachusetts and other jurisdictions, that may affect the OCME, its policies, or administration. Informs staff on a regular basis of important developments. Reviews case law, statues and other relevant decisions, regulations and information in order to assist in formulating agency policy and ensuring that the agency complies with the laws and regulations of the Commonwealth. Delivers in-house presentations on a variety of legal issues affecting the OCME, including attending in-house training sessions and professional conferences. Prepares reports and delivers oral presentations summarizing medical, factual, and legal issues relevant to legal inquiries. Serves as counsel to the Commission on Medico-legal investigation. Works closely with District Attorneys on OCME related matters. Maintains a working knowledge of the agency's collective bargaining agreements. Serves as the agency's public records access officer. Keeps timely records of case tracking data and assignment milestones. Works productively with fellow staff. Performs other legal and administrative tasks as required by the Chief.
Qualification and Experience
Qualification The candidate should have Juris Doctor from an accredited law school. Must be Member in good standing of the Massachusetts Bar Association. Must have 3-7 years’ experience in litigation. Demonstrated outstanding research, writing and speaking skills is required. Demonstrated litigation skills is required. Must have strong computer skills, especially with Microsoft office suite and Westlaw.
