Trusts & Estates Litigation Paralegal/Legal Assist Duties: Handle trust and probate litigation matters from inception to completion including preparation of initial pleadings as petitions or responses, assisting with the preparation of motions and or responses to motions, preparing discovery to be propounded and assisting clients with responses to discovery, coordinating the scheduling of and outlining depositions, preparation of chronologies, assisting with the docketing of and calendaring due dates, familiarity with local and state court rules (Oregon and California) in litigation and probate and trust litigation matters, drafting of mediation and settlement conference briefs, preparation of trial briefs and exhibits and witness lists, coordinating the identification of and retention of expert witnesses, addressing post-trial matters. Performing fact investigation and research, including witness interviews. Draft correspondence, discovery and other pleadings. Managing discovery materials, including reviewing documents for privilege/relevance, coding documents, analyzing data, and summarizing deposition transcripts, medical records or other material. Assisting in filings and preparation for depositions, hearings, and trial by assembling exhibits, handling subpoenas, and attending proceedings as needed. Handling summary and formal probate matters and trust administration from inception to completion. Prepare estate plan documents for Oregon and California clients, fund trusts and handle client correspondence/meetings. Administer Special Needs Trusts, including preparation and filing petitions with probate court and preparation of annual accounts. Administer Guardianship and Conservatorship matters including preparation and filing petitions with probate court and preparation of required accounts. Must be able to merge wills/trusts/estate planning documents. Obtain tax identification numbers for trusts and other entities. Prepare schedule of allocations to trusts under will and schedule of allocations of sub-trusts. Prepare and maintain docketing system. Obtain and review income tax returns and other financial records and coordinate with tax preparers. Evaluate and inventory probate estate and trust estate assets and obtain date of death and date of distribution values. Verify bank balances. Prepare inventories. Review will and trust provisions and report to attorneys. Administer trust-related matters, including preparation of annual Trustee’s Reports to beneficiaries, as required by statute and reports and accounts at termination. Consistent and punctual attendance.

Qualification and Experience

Requirements: Bachelor’s Degree preferred. ABA Paralegal Certification or commensurate experience preferred. 3+ years of paralegal experience in probate administration, trust administration, trust and estate litigation preferred. Hands-on experience and strong knowledge of estate planning, probate and non-probate proceedings, trust administration, irrevocable life insurance trusts, guardianships, estate and gift taxes required. Must be able to effectively oversee trust administration and asset distribution. Experience in multiple areas of estate planning and probate (federal and state tax, fiduciary and personal tax, gift tax, etc.) is desirable. Computer skills and knowledge of litigation management software, e.g. Summation, Digital WarRoom, Relativity, Vision, Excel, and other spreadsheet programs, etc. desirable. Proficiency with Microsoft Word and familiarity with Microsoft Access and Project is a plus. Ability to work independently under the direction of attorneys in the management of both small and large litigation cases. Knowledge/Familiarity of IRS procedures and regulations. Basic knowledge of legal research techniques and use of Internet with traditional and online research skills. Hands-on experience and knowledge of Federal and State Court practices, specifically Oregon and California and specifically probate court practice. Organized and detail oriented. Excellent oral and written communication skills. Strong problem solving skills.
