In-House Counsel
Responsibilities: Implement and guide consumer defense litigation strategy and author settlements and negotiations regarding to allegations of violations of consumer financial services laws, such as the FDCPA, TCPA, FCRA, EFTA, ECOA, UDAAP, FCBA, HIPPA, HITECH, GLBA, SCRA, BSA/AML/OFAC, data security, financial processes, contractual obligations, and related state-law corollaries. Refine strategies for addressing risks relating to servicing and collections. Develop and review customer and consumer communication templates. Review consumer complaints with legal and regulatory impact and assist in developing responses. Monitor state and federal consumer finance developments. Work with Compliance colleagues to facilitate remediation activities. Work with outside counsel and TSI personnel to gather documents and information related to lawsuits. Respond to escalated Consumer/Regulatory Complaints. Assist company with Attorney Network off-boards, inventory reassignments and other issues related to non-compliance. Review and interpret contracts with clients and network firms.

Qualification and Experience

Qualifications: JD Degree from accredited law school. 3-5 years’ post qualification experience required in a leading law firm or financial institution. Knowledge of and experience with federal, state and local consumer finance laws and regulations including relating to the FDCPA, TCPA, FCRA, and Unfair, Deceptive and Abusive Acts or Practices. Experience drafting consumer communications and responding to consumer complaints. Knowledge of consent orders relating to marketing, servicing and collections. Experience reviewing marketing materials and developing disclosures. Team player with inherent commercial judgment and strong analytical skills. Excellent attention to detail and strong organizational / project management skills. Strong oral and written communications skills. High level of initiative, integrity, and organization.
