Assistant City Attorney III, (B191610-3) Duties : Under the general direction of the City Attorney, perform highly responsible and professional legal services for the firm. Is responsible for assisting and providing oral and written legal advise, recommendations, and opinions to Department Directors, City staff, and committees on matters affecting City operations (with an emphasis on transactional work). Shall be responsible for drafting and reviewing contracts, real estate documents, resolutions, ordinances, and other written documents involving the City; performs legal research and preparing legal opinions, advises City officials and may represent the City in administrative proceedings. May be assigned to represent the City in ligations, including the brining and defending of suits and negotiating settlements, and assessment of risks and financial exposure to the City for non-compliance and matters affecting the daily operations of the City. May attend City Council meetings and advisory board meetings as needed. Advises City Departments in reference to legal questions which include duties in representing the City before various local and state departments and other governmental subdivisions. General direction is received from the City Attorney, however, the employee is expected to exercise considerable initiative and independent professional judgment in developing the technical aspects of the job. Drafts and reviews all forms of real estate documents. Performs accurate, thorough, and timely legal research and prepares opinions, briefs, pleadings, motions, discovery requests, memorandum, real estate documents, and correspondence on various legal problems for the City. Investigates cases, conducts oral depositions and other discovery proceedings, interviews witnesses, and gathers documents for presentation at the trial of cases. Prepares trial documents, including trial motions, requests for limiting instructions, and jury questions and charges. Attends Court for the hearing of all pre-trial matters, including motions for summary judgment and any other discovery motions or pre-trial motions. Prepares all cases for trial, subpoenas witnesses, and conducts the trials of cases in the trial court, including making opening statements, presentation of evidence, closing arguments, etc.; ensures cases are thoroughly and accurately prepared and conducted. Prepares all necessary post-trial motions and attends hearings thereon, including entries of judgment; prepares and files all necessary documents in order to appeal the judgment to state or federal Courts of Appeals; researches law and prepares written briefs on the law as it applies to the facts of the cases. Continually reads law publications and attends professional seminars in order to stay abreast of the latest developments in state laws. Attends meetings and conferences as required by the requesting department, board, or commission concerning problems or issues; confers by telephone with officials, department heads, and the general public. Prepares, drafts, reviews, revises, and approves resolutions, ordinances, contracts, deeds, leases, and other legal documents and instruments for various City departments; reviews such documents and provides opinions as to legal acceptability. Perform any other legal duty as directed and assigned by the City Attorney.
Qualification and Experience
Qualification : Must have Doctorate of Jurisprudence from an accredited law school. AND 4+ years practicing as a licensed attorney. Experience in the practice of government law is preferred. Certificate of admission to the Bar of the State of Texas and eligibility to practice law before the courts of the State of Texas is required.
