Deputy City Attorney Duties: Under general supervision, performs professional work advising city departments, City Council, and various City boards and commissions on legal matters and representing the City in court when necessary. Work involves serving in the absence of the city. Employee provides legal counsel to city departments to advise officials on issues with legal implication for the City; litigates all jury and non-jury complex cases on behalf of the City, its staff, and various Boards and Commissions, and practices in all courts of the Commonwealth of Virginia, Federal Courts (including Bankruptcy Court), U.S. Supreme Court, and administrative tribunals. Will provide in depth counsel on real estate, local taxation, land use and the related litigation. Fields of law practiced in this position include contract, employment, civil rights, personal injury (torts), constitutional, real estate, criminal, zoning, bankruptcy, and child welfare. Employee must exercise considerable initiative and independent judgment in various phases of work. Provide legal advice to City Council, City departments, and various City boards and commissions. Maintains responsibility for public relations for the Office of the City Attorney. Litigates jury and non-jury complex civil cases on behalf of the City, its staff, and various Boards and Commissions. Drafts, reviews, and approves all major documents for the City, including contracts, city policy, change orders, settlement agreements, letters, etc. Performs legal research and prepares memorandums of informal opinions regarding numerous fields of civil and criminal law. Drafts, reviews, and approves all real estate agreements, including deeds, easements, open space agreements, leases, etc. Serves in the absence of the City Attorney at City Council meetings, Planning Commission meetings, and various other meetings. Negotiates settlements on behalf of the City. Performs case management functions, such as preparing case documents, preparing order, requesting and responding to subpoenas, discovery, subpoena duces tecum, etc. Interviews witnesses in preparation for trial and represents City in mediations. Meets and converses with City employees and citizens regarding City matters. Conducts training on legal matters for City staff and City departments. Completes legal education courses as required by the Virginia State Bar. Performs other related work as required.
Qualification and Experience
Qualifications: Graduation from an accredited school of law with JD Degree and 8+ years of experience in the practice of law, preferably including work for local government; experience in local taxation law and related litigation; or any equivalent combination of training and experience which provides the required skills, knowledge and abilities. Must be licensed by the Supreme Court of Virginia and must be an active member in good standing of the Virginia State Bar. Prefer certified guardian ad litem, notary public, and admittance in the U.S. District Court, Bankruptcy Court, and U.S. Supreme Court.
