ProfileSenior Labor Counsel The candidate will advise senior management on a broad variety of labor and employment matters and to serve as management’s representative for collective bargaining matters affecting the assigned bargaining units. Will handle a substantial arbitration and labor and employment litigation caseload. Responsibility for all labor and employment litigation involving one or several MassDOT bargaining units and is expected to handle a demanding caseload while also serving as legal advisor to managers at all levels of authority. Work closely with assigned Labor Relations Specialists in determinations involving discipline and discharge; contract interpretation; grievance resolution and other labor matters and provide legal review of disciplinary recommendations, grievance decisions, and proposed settlements. Serve as the primary management representative on local and state-wide labor management committees and act as chief spokesperson during mid-term or impact negotiations for assigned bargaining units. Draft legal memorandum, settlement agreements, position statements, motions, pleadings, disciplinary recommendations, conduct investigatory interviews, research complex legal issues, and draft legal opinions on a variety of labor and employment issues. Should have 5-10 years of experience successfully handling complex arbitration and labor/employment litigation as well as demonstrated effectiveness in collective bargaining negotiations. Must have extensive knowledge of public sector bargaining, civil service law, state and federal wage and hour laws, workers compensation, unemployment, FMLA, ADA, ADEA and other state and federal EEO laws. Prior experience at a Massachusetts state agency or authority is a plus. Must have proficiency with Microsoft Office products and ability to adapt to changing technologies.
