Deputy General Counsel The candidate will provide supervision of members of the Legal Unit, including assigning and coordinating caseloads. Will assist with overseeing the procurement and contract processes within the Department. Assists with coordinating assignment, review, and supervision of legal action brought at the request of Field Operations. Provides oversight of the Department’s regulatory and st atutory compliance with state and federal laws. Monitors the Department’s compliance with federal legal requirements. Supports the Department of negotiating and enforcing its contractual obligations under collective bargaining agreements. Assigns subsidy hearings and provides legal advice on financial assistance matters. Coordinates administrative and superior court proceedings to enforce the agency’s regulations and requirements. Coordinates firm's enforcement actions with the Office of the Attorney General and other state agencies (i.e., the Department of Children and Families, The Department of Youth Services, The Department of Transitional Assistance and the District Attorney’s Office). Assists in reviewing and setting all policies and procedures for the agency that require legal review and ensures the process is conducted in a manner consistent with federal and state statutory and regulatory mandates. Advises on questions affecting firm's policy and practices with regard to their legality including contract and personnel issues, subsidy issues, conflict of interest, and liability issues. Acts as a member of the department’s leadership. Represents firm's in joint policy discussions with other state agencies, outside stakeholders, union organizations and advocacy groups. Designs, develops and implements internal and external training programs. Analyzes and assesses legislation and budget language that potentially impacts the agency. Provides legal support to the Deputy Commissioner for Administration and Finance to procure, execute and monitor contracts. Assists the Commissioner in responding to questions and issues raised by legislators on constituent issues. Provides guidance and assists with oversight of the public records request process within the agency. Additional duties as assigned.
Qualification and Experience
Qualification : The candidate must have current membership in the Massachusetts Bar and at least (A) 5+ years of full-time or, equivalent part-time, professional, administrative, supervisory, or managerial experience in a particular specialty (i.e. scientific, professional, or technical) and must possess current license and/or registration requirements established for the performance of the position, of which (B) at least 1+ year must have been in a project management, supervisory or managerial capacity or (C) any equivalent combination of the required experience and substitutions below. Substitutions: I. A certificate in a relevant or related field may be substituted for one (1) year of the required (A) experience. II. A Bachelor’s degree in a related field may be substituted for two (2) years of the required (A) experience. III. A Graduate degree in a related field may be substituted for three (3) years of the (A) required experience. IV. A Doctorate degree in a related field may be substituted for four (4) years of the (A) required experience.
