Associate General Counsel Duties: Interfacing with community stakeholders (Department of Social Services, Department of Juvenile Justice, families, providers, etc.) when Cardinal Innovations’ members are involved in the court system. Preparing internal staff for court appearances. Review and respond to third-party subpoenas for court appearances. Prepare reports for court in lieu of or in addition to appearing. Represent Cardinal in court if Cardinal Innovations is subpoenaed to attend. Oversee and manage Cardinal Innovations’ defense when members request State fair hearings following denials of requests for authorization of Medicaid-funded services. Coordinate with internal clinical operational units to recommend a strategy that is in the best interest of Cardinal Innovations and its members. Review and analyze data generated from the State fair hearing process to recommend operational opportunities for improvement. Support other attorneys in OGC in managing Medicaid and non-Medicaid appeals. Assist in managing Cardinal Innovations’ litigation activities, including but not limited to provider actions against Cardinal Innovations filed in the North Carolina Office of Administrative Hearings. Determine when internal versus external resources are appropriate to utilize in litigation. Efficiently manage outside counsel and serve as an interface between outside counsel and internal staff. Provide periodic reporting and trends to the Office of General Counsel and other operational units, as appropriate. Support other attorneys in OGC in managing Cardinal Innovations’ litigation activities. Review and develop contracts, assist in contract negotiation and monitoring and provide legal advice in the event of contract disputes. Provide legal advice in addressing non-compliance, terminations and related problems. Review and approve all final contracts as to form and with regard to legal and regulatory compliance. Review and respond to subpoenas requesting documents and/or testimony in matters in which Cardinal Innovations is not a party. Support and provide legal assistance to the Medical Records department in appropriately reviewing and responding to requests. provide general legal advice to operational units as requested. Areas of advice include, but are not limited to, applicability of powers of attorney, HIPAA, guardianship, the juvenile code, and Medicaid managed care. Provide education to Cardinal Innovations staff on legal issues as requested; pursue professional development and continuing legal education by attending workshops/conferences related to health law and regulations.
Qualification and Experience
Qualifications: Graduation from an ABA accredited school of law and 3-5 years of advanced professional legal experience, preferably in healthcare, is required. Must have a current and active license to practice law in North Carolina. Will be expected to pursue continuing legal education as required by the North Carolina Bar Association to maintain licensure in North Carolina and professional development in all areas of relevant federal and state law and regulations to the operations of Cardinal Innovations.
