Richfield office of our client seeks elder law/estate planning attorney with 3-7 years of experience. The candidate will have responsibility over client files and file management; heavy client interaction in person and over the phone. Will draft estate planning documents, Wills, Trusts, Powers of Attorney, Health Care Directives. Identify need for Medical Assistance or Veterans’ benefits applications; become familiar with Life Care Planning and develop a long term care plan; and research, analyze and develop expertise on Trusts including Supplemental Needs Trusts and Special Needs Trusts. Assess client’s estate planning needs and proficiently draft estate planning documents: Wills, Trusts, Powers of Attorney, Health Care Directives, Family Investment Agreements, Service Agreements, Real Estate documents and other documents as necessary. Recognize and address tax considerations and planning in the estate planning process. Draft probate and trust administration documents as well as non-Probate Estate Administration documents’ investment agreements. Represent Personal Representative or Trustee throughout Estate and/or Trust Administration process. Meet with clients; obtain information necessary to open estate, assets, creditors, heirs, family issues, personal property information. Assess client needs, make recommendations and develop a plan to address client’s situation. Have client interaction in person and over the phone. Independent responsibility over client files and file management. Meet with clients and develop a long-term care plan to include planning for community spouse if applicable, asset protection, gifting, annuities exempt assets and related issues. Identify need for Medical Assistance application, supervise application through entire process. Research, analyze and develop expertise on Trusts, including Supplemental Needs Trusts and Special Needs Trusts. Perform second review of estate planning documents for other attorneys and legal assistants as requested. Meet with clients to explain and execute documents. Become familiar with VA Planning. Become familiar with Life Care Planning and the utilization and incorporation of the Life Care Coordinator into Life Care Planning and Long-Term Care Planning files. Should have a focus on estate planning, probate and trust administration, medical assistance planning and Veterans’ benefits, and long-term care planning. Must be licensed to practice in Minnesota.
