Attorney - Housing Duties: Representing the City of Houston Housing and Community Development Department (HCDD) in various affordable housing acquisition, rehabilitation and development projects. Actively engaging with the U.S. Department of Housing and Urban Development (HUD), The Texas General Land Office (GLO), Federal Emergency Management Agency (FEMA), and other state and local authorities to ensure HCDD abides by and remains compliant with all federal, state and local fair and affordable housing requirements. Negotiating and drafting agreements, including inter-creditor and subordination agreements, with commercial lenders, nonprofit and for-profit developers, tax credit investors, agencies, other governmental entities, and other stakeholders in single-family and multi-family affordable housing projects. Drafting, reviewing or revising City ordinances that relate to various HCDD matters, including program guidelines, affordable housing programs and agency agreements. Reviewing and commenting on proposed federal, state, and local fair and affordable housing laws and regulations. Performing title review and drafting documents related to the City’s down payment assistance and single-family home repair, construction and reconstruction programs. Rendering legal advice to HCDD and other City departments regarding housing and general real estate law and land use matters. Drafting, reviewing or revising city policies to further the City’s goal of providing fair and affordable housing in the City. Special projects assigned by management. Managing outside counsel.
Qualification and Experience
REQUIREMENTS: Requires a JD Degree from an American Bar Association (ABA) accredited college of law. Must be a member of the Texas State Bar. 4 years' experience in the practice of general civil law or specialized municipal law are required. Preferences: 5+ years of experience in affordable housing law. Experience working with HUD, GLO, FEMA, and other federal, state, and local governmental entities. Familiarity with the 2 CFR Part 200 as it relates to federally funded projects. Experience with Section 108 and/or Community Housing and Development Organization (CHDO) transactions. General understanding of federal, state and local rules relating to affordable housing. Experience working with real estate developers and commercial lenders planning and developing affordable housing projects to deliver services to low- and moderate-income individuals and families. Experience with project management. Familiarity with third party agreements whereby a governmental entity provides federal monies to third- party public and non-profit organizations to provide public services including services related to housing, health and youth. Experience drafting and negotiating contracts, loans, and grants for affordable housing, public services and/or public facilities. Excellent drafting, analytical, and organizational skills. Familiarity with Texas real property statutes and municipal or public law. Familiarity with procurement requirements, policies and procedures. Experience providing legal and tax advice to city officials regarding Community Land Trusts.Must be willing to work extended hours as needed to accommodate workload demands. Proficiency with the Office 365 suite of programs, including Word, Outlook, Excel and the use of technology in the practice of law. Excellent communication skills.
