Announcement number SCBK189677889338 Control number 510704800 Duties Summary About the Position: Serve as the Attorney-Adviser (General) for the United States Army Space and Missile Defense Command/Army Forces Strategic Command's (USASMDC & ARSTRAT's). Responsibilities Serves as Principal Attorney Advisor for General and Administrative Law as it applies to the missions and functions of the Command which is a field operating agency of DA, reporting directly to the Vice Chief of Staff, Department of the Army. Serves as a principal legal advisor to Command Officials on problems arising from lawsuits, court actions, board hearings within the Executive Department, and other legal proceedings requiring representation. Represent USASDC and provide legal advice to Command officials on any matter relating to the administration of USASDC civilian personnel and contractor employees. Advises Command Officials on policies and procedures in the field of appropriated and NAF acquisitions and allied matters to include reports of any violation of 31 USC 13451, 31 U.S.C. 1342, and 31 USC 1517. Advises Command Officials on foreign, comparative, and international law, affecting the operation of USAKA, now recognized as a foreign nation under the Compact Of Free Association and attendant agreements. Serves as Environmental Law Specialist for the Command, advising on all environmental legal matters arising from any USASDC activity. Provide legal advice relating to the organization, powers, and functions of the Command to include the authority of a military installation commander. KSAs: Knowledge of Litigation: This includes litigation involving USASDC brought by or against any Command Official; litigation between a government contractor and a third party the result of which will affect any term or condition of an existing USASDC contract; contract claims or potential claims which may result in a Contracting officer decision under the Disputes Act of 1978 or prior legislation and regulation and Contract Appeals; appeals of decisions by the Merit systems Protection Board and the Equal Employment Opportunity Commission on personnel matters; and on any proceedings involving a USASDC contractor under the Federal Bankruptcy Act as amended. Knowledge of Labor and Civilian Personnel Law: Reviews all disciplinary actions proposed against any USASDC employee and all formal Equal Employment Opportunity complaints filed by any USASDC employee. Knowledge of Fiscal, Tax, and Property Law: Advises on the applicability of Federal, state, or local taxes to contract activities of USASDC and processes all USASDC tax cases under litigation responsibilities. Knowledge of International Law: Advises on the applicability of other U.S. Laws as well as various arms control treaties and agreements to the operation of USAKA. Knowledge of Environmental Law: Reviews and advises Command Officials on all records and documents (Records of Environmental Consideration, Environmental Assessments, Findings of No Significant Impact, Notices of Intent, Environmental Impact Statements, and Records of Decision) for compliance with the National Environmental Policy Act of 1969 (NEPA) and regulations promulgated by the Council on Environmental Quality (CEQ) as implemented in Army Regulations (AR). Knowledge of Administrative Law: Interpreting and application of law relating to command activities including the control and access to an installation in accordance with applicable AR.
