Assistant City Attorney/Prosecutor DUTIES: Receives and reviews claims and lawsuits filed against the City and recommends settlements to assist and represent the City in its defense. Prepares and presents special and recurring reports, forms and documents, written and oral legal opinions, and prepares and drafts a variety of correspondence including letters, memos, and pleadings to provide information and status regarding various items to include litigation, settlements, and negotiations. Prepares for and participates in court appearances including hearings, arbitration, and trials; arranges for and attends depositions and prosecutes criminal cases. Attends and participates in various meetings; provides legal support and advice to City employees. Receives and responds to public inquiries, citizen complaints, and requests for information. Performs legal research utilizing various formats and mediums to obtain information.

Qualification and Experience

QUALIFICATIONS: JD Degree plus 1 year of experience in criminal prosecution. A combination of education, experience, and training may be applied in accordance with City of Las Cruces policy. Must be a member of the New Mexico State Bar Association, licensed to practice law in the state of New Mexico, and remain active with all New Mexico Bar annual requirements. As experience is gained, there is greater independence of action and further development and use of professional concepts, policies, and procedures to solve a variety of issues. Knowledge of: State of New Mexico criminal and civil statutes, rules, case law, administrative orders, policies and procedures, and applicable Federal rules and regulations; Federal, State and local laws, rules and regulations affecting planning, water and land use, public utilities, community development and leases; legal precedents and court decisions impacting municipal government; court procedures, rules of evidence, protocols and strategies; legal research methods, techniques, sources, databases and other research tools; legal case management procedures and techniques; principles and protocols for the evidentiary gathering of information, documents, financial records and other data that may be used in court and legal hearings; City Attorney’s protocols and strategies of negotiation and litigation; principles of the development, refinement, and presentation of legal strategies; business and personal computers, and applicable software applications; City organization, operations, policies and procedures to effectively perform the required. Ability to: perform a variety of duties and responsibilities and assess and prioritize multiple tasks, projects, and demands to meet critical deadlines; read, understand, interpret, and assure compliance with a variety of policies, procedures, rules, and regulations governing related activities, and functions; analyze, appraise, and organize facts, evidence, and precedents and to present such information and materials in a clear and logical form; prepare and present information in a clear and concise manner orally and in writing; effectively present cases in court; research and compile applicable information and maintain accurate records; maintain confidentiality of sensitive information and data; review documents and extract relevant information; establish and maintain effective and appropriate working relationships with employees, public officials, other agencies, and the public; take initiative and exercise sound independent judgment within established procedural guidelines to ensure achievement of goals and objectives. Skills in: Researching and identifying precedents in case law; negotiating agreements; litigating cases in a legal hearing and courtroom setting; reviewing and assessing legal issues and documents; effectively assessing, interpreting, and applying criminal and civil laws to information, evidence, and other data compiled; conducting research, and utilizing and evaluating data in various formats and mediums; operating a personal computer with installed generic and specialized software; preparing and presenting information in a clear and concise manner; assessing and prioritizing multiple tasks, projects and demands; interpreting technical instructions and analyzing complex variables.
