Regional Attorney Duties: The candidate provides oversight to a staff who is responsible for providing legal services and support to the programs administered by the USDA agencies that have regional and state offices throughout the Mountain Region comprised of eleven states. Manages and supervises three offices located in Denver, Colorado, Missoula, Montana, and Albuquerque, New Mexico. Also responsible for special assignments from the General Counsel and Deputy General Counsels involving matters of considerable complexity, sensitivity, difficulty, and significance to the Department's programs. Handles and oversees many important and difficult legal problems that occur in the Region such as issues dealing with the National Environmental Policy Act, National Forest Management Act, and Endangered Species Act, water rights and water facilities, mining and energy development, and grazing and range. This includes providing legal counsel to agency heads of regional and field offices, conferring with officials of DOJ on the potential effects of litigation on Departmental policy, and providing to key officials and private sector attorneys the basis for Departmental positions on difficult legal issues. Prepares for and litigates cases before administrative law tribunals, including the Agriculture Board of Contract Appeals, Equal Employment Opportunity Commission, National Appeals Division, and the Interior Board of Land Appeals. This includes preparation or review of motions, complaints, answers, subpoenas, briefs, memoranda of law, and other litigation related documents. Advices and assists on freedom of information and right of privacy issues, tort cases, civil rights, and employment discrimination. Advices on loan applications including eligibility determinations, approval of legal aspects of loans made under various programs administered by the Farm Service Agency, Rural Development, and the Commodity Credit Corporation, and assistance in servicing such loans. Performs all legal work in real property transactions, including review of Abstracts and Title Opinions and the preparation of final Title Opinions in connection with acquisition or exchange of lands by the US. Work will affect individuals, businesses, organizations, municipalities, and other interested, parties involved in farming, ranching, rural business development, conservation, and land management.
Qualification and Experience
Qualifications: The candidate should have a professional law degree (LL.B. or J.D.) and active membership of the Bar of any state, the District of Columbia, or the Commonwealth of Puerto Rico. Must have demonstrated experience in litigation at trial and before administrative bodies and in a broad range of legal disciplines, including environmental law, commercial law, Federal Torts Claims Act, and administrative law. Should also have demonstrated experience in providing sound oral and written legal advice and counsel to senior executives and management officials in analyzing complex legal problems, in making sound legal decisions, and in supervising and managing highly skilled attorneys and support staff.
