Senior Attorney Duties: Provides day-to-day advice and legal research on all aspects of the employee/employer relationship on topics such as employment discrimination and harassment, at-will employment, various leaves of absence, benefits, drug testing, background checks, wage and hour matters, and employment law-related government contractor requirements. Provides day-to-day litigation support on demand letters, administrative agency charges, and single-plaintiff lawsuits, including handling certain matters internally or choosing to work closely with outside counsel on case strategy, legal positions, discovery, budget, settlement, and decision-making from commencement to conclusion of matters. Provides day-to-day legal advice and legal research on interpretation and administration of up to ten collective bargaining agreements at three airlines. Drafts or reviews and revises amendments, side letters, and letters of agreement. Manages all aspects of labor arbitration under the Railway Labor Act (RLA) for assigned craft or classes of employees, including trying and briefing arbitrations or choosing to work closely with outside counsel on same. Participates, as requested, as the legal team member in labor contract negotiations for assigned craft or classes of employees. Reviews recommendations for terminations or reduction in force for non-union employees and reviews or drafts separation and/or severance documents. Partners with HR, as requested, in the development and implementation of employment policies and practices. Provides legal guidance to HR regarding compliance with all employment and labor regulations, such as leave laws and wage-hour laws. Reviews course of action for discipline and termination of employees under labor contracts and provides related legal advice. Designs and presents labor and employment law training programs for HR, labor relations, and employees in operational divisions, including programs on disciplinary practices, arbitration preparation, employee investigations, disability and discrimination laws, and leave laws.
Qualification and Experience
Qualifications: JD Degree, with strong record of personal academic achievement. Licensed attorney in good standing of at least one state bar. 6+ years of employment law advice and counseling experience. 6+ years of employment litigation experience. 2+ years of traditional labor law experience. Some experience as first chair attorney representing clients in labor arbitrations. Past experience as the relationship partner and/or primary senior associate for clients. Excellent delegation and planning skills. Strong interpersonal skills and ability to communicate effectively with a diverse and large internal customer base and to seek out and collaborate with colleagues in the Legal department. Detail oriented and highly organized, with the ability to execute on multiple projects, priorities, and deadlines and work independently with limited guidance in a fast-paced environment where flexibility is key. Proficiency with Microsoft Office applications (e.g., Word, Excel, PowerPoint, and Outlook). Preferred: Railway Labor Act (RLA) knowledge and experience. First or second chair collective bargaining table experience. Knowledge of the airline industry. Knowledge of Employee Retirement Income Security Act (ERISA) Experience with Office of Federal Contract Compliance Programs (OFCCP) and Affirmative Action Programs (AAP).
