Senior Director of Legal Litigation The candidate will assist the Vice President of Legal Litigation with all aspects of claims and litigation. Will represent the organization regarding litigation and claims as assigned. Prepare supporting legal documents such as briefs, mediation statements, discovery and other filings. Assist with setting case reserves and risk management functions. Attend mediations, arbitrations and trials as needed. Monitor outside counsel in various states. Interact with company departments regarding claims and risk management providing guidance when necessary. Responsibilities: Provides legal research, analysis, factual information, counsel and guidance on legal questions or issues. Works closely with company associates as needed to fully investigate claims. Works closely with external clients while resolving legal issues, manages outside counsel and negotiates settlements. Supervises and prepares cases for defense in litigation. Participates in court appearances, trial preparation, motions and discovery. Studies proposed and existing legislation. Attends mediation, arbitrations and trials. Anticipates and guards against legal risks involving the organization. May assist with class action litigation when requested. Monitors billings from outside counsel for expense control. Communicates with insurance adjusters when necessary. Consults with insurance brokers regarding coverage issues. Manages eDiscovery and litigation holds. Acts as a member of the Reserve Committee. May coordinate and manage class action lawsuits. Works proactively with Senior Director of Operational Risk Management regarding risk controls and mitigation. Works proactively with Legal Operations and Field Operations in the context of litigation and risk management.
Qualification and Experience
The candidate should have J.D. degree, licensed in at least one state. Experience in general and personal injury liability in a healthcare setting, including familiarity with medical records and concepts. Multi-state representation and in house counsel experience preferred. Must be willing to travel. Excellent knowledge of laws and regulations applicable to federal and state healthcare laws. Excellent time management, communication, decision-making, presentation, human relations, and organizational skills. Knowledge of class action litigation a plus. Excellent negotiation skills.
