Senior Associate Counsel
The candidate to manage real estate legal services throughout the health care system. Reporting to the General Counsel, will provide legal advice to leadership and will serve as an integral member of the legal team. Must have strong management skills and the capacity to function well in a fast-paced, complex organization. Work closely with clinical, administrative and finance leadership on real estate transactions and matters to advance the system's operational and strategic goals. Oversee a broad real estate portfolio that includes major construction projects, substantial leasing activity, and real estate acquisitions and sales. Specific responsibilities include: negotiating and preparing leases and amendments; analysis of fraud and abuse laws applicable to real estate transactions and compliance in such transactions; oversight of large scale construction projects, including architect and construction contracts; purchase and sale transactions; license agreements; advice regarding real estate litigation; land use and zoning matters, policy development; analysis of existing and evolving federal and state regulations applicable to real estate matters; and supervision of outside counsel and in-house staff.

Qualification and Experience

The candidate should have Juris Doctor degree from an accredited law school. Should be Licensed and admitted to practice law in NYS or another state.5 years of real estate experience required; longer experience preferred. should have expertise in real estate transactions, including commercial leasing, purchase and sale contracts, closings, appraisal review, land use and zoning matters, and construction contracts. Must have excellent drafting and negotiation skills. Experience with health care real estate matters, including the fraud and abuse laws, such as the Stark Law and Anti-Kickback Statute, desirable. Must have keen problem-solving skills and the ability to function effectively in a dynamic, mission-driven organization. Should have strong analytic skills and professional judgment; the capacity to assess the business and legal terms of transactions and identify solutions to achieve closure. Must have excellent management skills; the ability to supervise and collaborate effectively with outside counsel, in-house attorneys, brokers and other parties to support initiatives across the health system.
