Trial Attorney The candidate will provide superior legal services that exceed our client’s expectations of quality and value and to be considered the best insurance defense litigation firm in each community where we practice. Reports to Managing Trial Attorney or Assistant Trial Attorney. Provide high quality, high integrity legal representation in personal injury, defense litigation. Managing a case load of complex legal issues for Nationwide clients; Proactive in case strategy and reports; Initiate and maintain substantive, constant and professional communications with internal and external customers; Contributes and provides subject matter expertise on significant, high-risk, and complex legal matters; Represents members in trials or hearings before courts or agencies, including appeals and arbitrations; Evaluates cases in accordance with Nationwide Trial Division best practices; Collaborate, direct and oversee the activities of support staff to accomplish goals; Recognize and promote settlement opportunities; Shares relevant information with members and Nationwide Claims department to ensure they are fully informed; Obtain meaningful discovery through deposition of parties and experts; Participate in motions practice as warranted; Completing other litigation and file handling tasks as needed. Independently leads or works directly on high risk, complex and/or difficult legal matters, representing clients in trials or hearings before courts or agencies, including appeals or arbitrations. Reviews and evaluates cases and lawsuits in accordance with NTD Best Practices guidelines. Demonstrated proficiency interpreting Insurance contracts and coverage issues; strong knowledge of state and local practices and rules. Works with client and claims to establish, communicates and implements Litigation plan. Keeps client and claims fully informed. Fosters and develops relationship with Claims; has contact with Claims management and uses initiative to help expand and retain business. Prepares and tries cases of high complexity and exposure in all courts and agencies including cases involving toxic substances, extensive injuries, permanent injuries and/or ongoing treatment. Cases may involve inflammatory factors (DUI, death of a child, egregious). Recognizes, participates and promotes settlement opportunities. Negotiates as authorized settlement value requires adjuster's second level manager approval. Obtains meaningful discovery, takes depositions, and participates in motion practice as warranted. May mentor other attorneys with respect to deposition practices and techniques. May train or mentor less experienced trial attorneys or paralegals on procedural or legal issues. May conduct training for Claims. Should have 8+ years of insurance defense litigation experience. Commercial insurance defense casework including Workers Compensation is preferred. Trial experience, and agency hearing representation experience is also required. JD Degree from an accredited law school is required. Must be licensed as an attorney in appropriate US jurisdiction.
