Counsel IV - e-Commerce Payments The candidate will provide effective and strategic legal and regulatory advice and support for enterprise-wide e-Commerce operations internally supporting company's virtual channels, innovations, payments, retail, small, business, and wholesale internet businesses. Legal responsibilities will focus principally on digital payments (e.g., person-to-person payments, bill pay, real-time payments, online wires, etc.), online and mobile product development and related operations, contract negotiation support involving FinTech companies, and risk management for company. May also provide additional support for enterprise data and analytics and information technology, as needed. Advise and support product managers, risk and compliance managers, IT professionals, technologists, system architects, and data security professionals in the design and implementation of mass-marketed financial products and services distributed through online, mobile, and social media channels.
Qualification and Experience
The candidate must have 8+ years of experience as a practicing attorney OR 6+ years of experience as a practicing attorney and 2+ years of experience in one or a combination of the following areas: risk, compliance, contracts, government/regulatory, financial services, or technology. Should preferably have 5+ years of relevant legal experience working in a financial services or financial technology corporate law department, or in a financial services practice group of a national law firm. Active State Bar membership is required. Should be knowledgeable, experienced, and proficient with legal issues and related laws and regulations in electronic funds transfers, online and mobile banking, including laws related to electronic and mobile commerce, electronic contracting and third-party risk management, payments, authentication, cybersecurity, electronic delivery of information, web accessibility, online privacy and social media (e.g., ESIGN, EFTA, TCPA, ACH rules, GLBA, FTC and FFIEC guidance. Should have broad experience with large and often enterprise-wide, global, or multinational technology and operations projects, involving a geographically diverse customer base, diverse personal technology, FinTech, and diverse levels of digital-media user experience. Must be skilled with gathering information in a fast-paced business environment, understanding business needs and goals, and working with intensity toward effective, practical, and timely legal solutions. Extensive knowledge and understanding of research, counsel, and guidance on complex legal questions or inquiries is preferred. Direct experience advising financial institutions on payment initiatives, including digital wallets, real-time payments and Regulation E is desired. Should preferably have knowledge of laws affecting e-commerce, mobile commerce and payments (e.g., ESIGN, EFTA, TCPA, ACH rules, GLBA, FCRA, FTC and FFIEC guidance); and mobile commerce, and social media; and information privacy.
