General Counsel The candidate will ensure the operations of the Legal Services department support the goals and objectives of the district. Will direct staff in the rendering of services for the district, including accepting service of process for citations. Direct staff in the preparation of documents and pleading, when needed, in regard to misdemeanor cases served on the district and its employees. Direct staff in representing the district in civil litigation and administrative proceedings. Advise the Board of Trustees and Superintendent in the execution of contracts. Act as consultant and advisor to the Superintendent of Schools, department heads, administrators, and other staff on matters pertaining to the formulation and execution of policy. Represent, or direct staff in representing, the district, the Board of Trustees, and/or administrators before the EEOC, The Texas Commission on Human Rights, and other civil rights enforcement agencies. Oversee the drafting of legal documents, rules and regulations, resolutions, applications of diverse kinds, inter-local agreements, and all other legal or quasi-legal papers upon request. Negotiate and draft contracts for the acquisition of real and personal property, the employment of architects, contract management firms, contractors, and other entities. Provide legal assistance in the drafting of state legislation proposed by the district for presentation to the Texas State Legislature and other government entities. Review legislation introduced in the State Legislature and interprets the impact of such legislation on the interests of the district. Request advice and information from governmental agencies and regulatory bodies, as needed. Oversee the counseling of district employees on legal problems arising in the course and scope of their employment. Develop and manage the annual departmental budget. Direct the development of programs and methods for establishment of standards of performance and the evaluation of performance against these standards for the purpose of aiding operating divisions in the attainment of their own and district objectives. Direct the development and maintenance of such records and reports as are necessary for the Superintendent of Schools, and other executive staff, to keep the Board of Trustees informed of the district’s progress and future plans. Directly supervises 6 School Attorneys and 1 Operations Executive.
Qualification and Experience
The candidate should have Doctor of Jurisprudence Degree from an accredited law school; licensed by the State Board of Law Examiners of Texas as an Attorney and Counselor at Law. Must have 10+ years of directly related experience. Must have demonstrated knowledge of federal and state school laws, employment law, and contract law. Ability to represent the district in administrative hearings and negotiations with vendors, contractors, and other entities is required. Demonstrated management, operational planning, and budgeting skills needed. Strong organizational, communication, and interpersonal skills required.
