Profile

General Attorney (Tax) - Health and Welfare Branch, GS 14
Duties: The candidate will provide top quality legal advice and representation to the Agency in the administration of the nation's tax laws. Will handle all aspects related to professional legal work involving one or more of the following areas: Health and Welfare Benefits - § 79 - group term life insurance; § 104 - compensation for injuries and sickness (except § 104(a)(2)); § 105 - accident and health plans; § 106 - employer provided coverage under accident or health plans; § 125 - cafeteria plans; § 129 - dependent care assistance programs; § 223 - health savings accounts; §§ 419 and 419A - funded welfare benefit plans; § 501(c)(9) - voluntary employee beneficiary associations (VEBAs); § 4980B - continuation coverage requirements of group health plans (COBRA); § 4980H - employer shared responsibility provisions; § 4980I - excise tax on high cost employer sponsored health coverage; § 6056 - employer health care information reporting; §§ 9801 through 9833 - HIPAA and related health care benefit provisions.

Qualification and Experience

Qualifications: The candidate should have graduated with a J.D. and/or the LL.M from an ABA-accredited law school. Must be admitted to practice law before the highest court of a state or territory of the United States; the District of Columbia; or the Commonwealth of Puerto Rico and be an active member by the closing date of the announcement.

For GS-14: The candidate must have a J.D. degree and 1 year of general legal experience, plus 2 years of legal tax experience (1 year of legal tax experience must have been comparable to the GS-13 level) OR an LL.M. plus 2 years of legal tax experience (1 year of legal tax experience must have been comparable to the GS-13 level).

Specialized Experience: In addition, the legal tax experience must have included experience working on the basic concepts underlying the federal taxation of various employer-sponsored health and welfare plans (including familiarity with the Employee Retirement Income Security Act (ERISA)). The professional tax experience must include handling of sophisticated legal issues and interpretations related to employer-sponsored health and welfare plans.
