Attorney Advisor Duties: Handle a number of specialized legal issues of the Bureau including: (1) real property acquisition issues involving surface, mineral, and water rights, acquired through voluntary purchase, donation, transfer from other federal agencies, and condemnation; (2) real property management and disposal issues such as rights of entry, leases, permits and easements, use of Bureau property by third parties, historic and cultural property issues with SHPOs and Indian tribes, municipal regulatory actions and territorial annexation, and acquisition of constitutional jurisdiction; (3) full range of environmental issues for the Bureau regarding all applicable environmental laws/regulations/ and permitting requirements pursuant to the CAA, CWA, RCRA, NEPA, ESA, CERCLA, and others, including inspections by federal and state environmental regulators, responses to Notices of Violations (NOVs) and other asserted non-compliance or permit violation notices, proposed penalties, responses to environmental spills, leaks, or discharges, and sewage and water quality issues; and (4) OSHA inspections and compliance matters, including responses to Notices of Unsafe or Unhealthful Working Conditions and Requests to Investigate.
Qualification and Experience
Qualifications: Must have a JD degree, be an active member of the bar (any U.S. jurisdiction), and have 1+ year post-J.D. legal or other relevant experience. Preferred: Prior experience in environmental regulatory matters, OSHA compliance, appearances before administrative regulatory bodies, real estate acquisitions, Federal real and personal property management, the Administrative Procedure Act, and litigation related thereto; and demonstrated negotiation skills is highly desired.
