Labor & Employment Associate Duties: Employment litigation defending employers in single-plaintiff claims, class and collective actions, and suits to enforce and oppose enforcement of restrictive covenants, including taking plaintiffs’ depositions, defending depositions of employer witnesses, drafting and responding to written discovery, managing e-discovery, briefing dispositive motions, examining witnesses at trial or in arbitration, and conducting mediations and settlement conferences. Regular principal responsibility for investigating and responding to administrative charges at the EEOC and similar state and local agencies, including witness interviews, position statements, and appearances at fact finding conferences and mediations. Direct and independent client counseling of in-house attorneys, human resources professionals, and managers on wide array of labor and employment issues, including individual terminations, reductions in force (including adverse impact analyses and OWBPA disclosures), compliance with federal, state and local employment laws and regulations (including ADA, FMLA, FLSA, WARN, and whistleblower and anti-retaliation laws), classification of workers as employees or independent contractors, mergers and acquisitions, and internal investigations. Drafting and negotiating employment agreements, restrictive covenant agreements, employment policies, and separation and release agreements.

Qualification and Experience

The candidate with Strong academic credentials from a nationally recognized law school. Must have 2-5 years of law firm experience in employment litigation, employment counseling, and traditional labor experience. Traditional labor experience representing employers in NLRB proceedings, union avoidance, collective bargaining and labor arbitration. Appellate experience desired. Must be an excellent writer with finely honed analytical skills, able to handle multiple matters with independence and sound judgment, and able to work effectively and efficiently with other attorneys and staff inside and outside of the Labor & Employment Group.
