ProfilePublic Defender The candidate, under administrative direction, plans, organizes, and directs the legal activities and services of the Public Defender's Office; and to do related work as required. Plans, organizes, and directs a program for providing legal counsel and representation to eligible persons accused of criminal offenses; formulates and applies policies related to the Public Defender's Office; assigns criminal calendar to appropriate staff members; consults with staff on the conduct of cases in progress and gives advice and assistance as necessary; directs procedures to determine eligibility for Public Defender's Office services; reviews and evaluates completed staff work; discusses the public defense program with judges, prosecutors, law enforcement officials, and other persons to obtain information and possible action relative to defendants; personally appears in court as defense attorney of major and other cases or at arraignment to obtain first-hand knowledge of cases going to court; confers with office staff on record keeping and reporting systems and initiates changes as required; prepares and administers departmental budget; and prepares correspondence and reports.
Qualification and Experience
The candidate should have active membership in the State Bar of California. Must have 5+ years of experience as a practicing attorney, including 3+ years in the practice of criminal law. Should preferably be a fair, competent, and consistent criminal defense attorney with a broad legal background and significant senior management experience overseeing work of subordinate attorneys. Must have knowledge of: philosophy and practice of indigent defense in the US; duties, powers, limitations, and responsibilities of indigent defense counsel; principles of criminal law and its application; trial and hearing procedures; rules of evidence; legal research methods; principles of supervision and training. Should have ability to: defend criminal cases; perform legal research; analyze and apply legal principles, facts, evidence, and precedents to complex legal problems; present law, facts, evidence, and arguments clearly and logically in written and oral form; effectively represent the Defender's Office in legal proceedings and hearings; deal effectively and tactfully with members of the legal profession, public officials, and other persons contacted in the work; and train, supervise, and evaluate staff.
