Collections Attorney
The candidate works directly with the Assistant General Counsel to focus and maximize collection efforts. This involves reviewing, negotiating and resolving files in various stages of the probate process, providing input to maintain agency-wide compliance with both client requirements and applicable laws and regulations, and providing legal research and support to agency staff in furtherance of both client and agency goals. Effectively communicates and negotiates claims, liens and/or judgments in compliance with client directives and applicable laws and regulations. Maintains a queue of claim files to maximize timely claim payment and estate resolution. Thoroughly reviews settlement offers brought in from other business units in light of estate inventories, pertinent factual considerations and client and agency goals. Responds to and addresses inquiries from various business units throughout the agency to assure compliance with applicable laws and regulations. Continuously evaluates and audits current policies, procedures, and documentation for compliance with government laws and regulations and make recommendations to implement policy and process improvements as needed. Assists with the identification of potential risks and compliance issues associated with new products and services and recommends policies and procedures to ensure that new products and/or services are in compliance with applicable laws and regulations. Actively follows current industry and regulatory trends and activities to determine impact or possible impact on agency activity. Should have Understanding of the probate process and various types of probate. Should have working knowledge of the Fair Debt Collection Practices Act, Telephone Consumer Protection Act, PCI Security, SAS 70/ISO (a plus) and additional state and federal laws and governing bodies applicable to the collection industry. Should have Law Degree from an accredited law school. Should have Active license to practice law in Minnesota. Should have 2-4 years relevant experience. Should have general knowledge of estate law, estate planning and/or bankruptcy.
