Temporary Senior Counsel - Global Labor and Employment The candidate will deliver exceptional, strategic, and cost-effective legal advice and solutions while minimizing legal risks, proactively support the company's business operations, drive continuous improvement of the company's legal and business processes, and develop effective risk mitigation strategies in the best interest of the company. Manage (through outside counsel) employment-related litigation and charges as well as respond to demand letters in the US and Canada. Report to the Vice President and Deputy General Counsel - Global Labor and Employment. Manage employment litigation and charges throughout the United States and Canada, which will include representing the company in mediations and directing strategy and work of outside counsel in line with business initiatives and budgetary considerations. Regularly partner with HR professionals, operations, and company executives to provide timely and practical business-sensitive advice and risk assessments about strategic initiatives with a full range of employment law implications. Train supervisors and HR professionals on litigation avoidance and other employment-related legal matters. Manage internal compliance projects to reduce legal risk. Perform other duties as assigned.
Qualification and Experience
The candidate should have a Master's degree with a J.D. degree from an accredited top-tier law school. Must have 5+ years of experience of legal experience, ideally gained through a combination of law firm and in-house roles. Should also have 4 years of experience with specialization in employment law, including litigation experience with Title VII, FMLA, ADA, ADEA, FLSA, WARN, PDA, USERRA, NLRA, and workers' compensation retaliation and equivalent state laws. Must be a member in good standing of a State Bar. Experience with California employment laws is required. Class and collective action experience is needed. Should have prior experience handling all phases of pre-litigation and litigation: responding to demand letters, preparing position statements in response to charges of discrimination filed with the EEOC and state agencies, taking depositions, handling mediations, appearing and arguing before judges, ALJs, and arbitrators, drafting dispositive motions, preparing witnesses, and some jury trial experience. Prior human resource and compliance experience with traditional labor matters is helpful. Must have demonstrated experience providing balanced and nuanced counsel to HR and business professionals as well as to top-level executives on labor and employment matters. Experience training employees and managers (both in person and via webinar) regarding employment law principles and best practices is essential. Must have experience with reductions in force, WARN Act compliance, acquisitions and divestitures, restrictive covenants, and policy drafting and review. Exposure to employment issues in Canada, Puerto Rico, and Mexico is a prerequisite. Fluency in French and/or Spanish is needed. Some limited travel will be required.
