Litigation Attorney The candidate will be responsible to defend the company and litigate various types of cases in both state and federal court, as well as arbitrations, and assist in a variety of litigation functions. Litigate mostly personal injury cases and perform all necessary functions to defend a legal case from inception through trial/final hearing, including the following: Draft pleadings and motions to be filed with the court which will defend the company's position on various legal issues (these tasks may occur at anytime during the course of litigation). Conduct and defend depositions of plaintiffs, witnesses, medical providers, and experts (these tasks may occur at anytime during the course of litigation). Provide periodic updates to P&I club regarding the status of cases and provide legal advice on how to proceed with the litigation and strategy (this requires an initial summary of the case and completion of case management questionnaires). Routinely make decisions concerning the management of litigation files such as who needs to be deposed, what motions need to be filed, what records need to be obtained, and ultimate strategy on what is best for the company based on the development of the case. Conduct mediations in order to resolve cases and reduce the company's liability (this task is typically completed after certain depositions and discovery have been completed, but may be done earlier depending on the Court's order). Perform legal research in order to support the company's legal position (this task may be done when filing briefs, motions and/or memorandums with the court or when conferring with opposing counsel on various legal issues). Perform other job related functions as assigned, including, responding to subpoenas, responding to writ of garnishments, drafting correspondence to third parties, litigation of matters as needed, and attend to other tasks as needed from a legal perspective.
Qualification and Experience
The candidate must have a Law degree from an accredited program with admission to Florida Bar with ability to practice in both State and Federal Courts in Florida. 2-5 years of experience in major law firm or legal department handling all aspects of litigation is needed. Must have a background and working knowledge of General U.S. Maritime Law, including the Jones Act. Experience in litigating passenger and crewmember claims is critical. Intermediate-level knowledge of Microsoft Office, Lexus Nexus, Westlaw, and Microsoft Outlook is mandator. Exceptional oral and written communication skills are needed.Ability to handle all aspects of litigation, including hearings, depositions, discovery, mediations and trials is required. Ability to handle full caseload and work successfully in a critical team environment is essential.
