Deputy Chief Legal Counsel The candidate will under the supervision of the Deputy Chief Legal Counsel and together with other members of the Office of Chief Legal Counsel, assists in the provision of all legal oversight and legal services for the Authority. This includes commercial transactions, governmental issues including FOIA and OMA, health law issues, contract negotiation and drafting, administrative law issues, privacy issues including HIPAA and 42 CFR part 2, litigation, employment, and other necessary legal services. Understands and directly answers complex legal questions. Responsible for legal matters involving Medicaid, Medicare and Dual-Eligible behavioral health programs including Medicaid Waiver matters. Serves as a resources for the interpretation and application of the Michigan Mental Health Code including matters involving recipient’s rights. Responsible for review and/or drafting of all direct service provider, sub-recipient, professional services, and independent contractor agreements, including, but not limited to: SUD, Autism, Children’s Waiver, SED Waiver, HUD, Mental Health First Aid & QPR, and Evidence Based Supported Employment. Responsible for legal matters involving the Authority’s Crisis Continuum including negotiating and drafting contractor agreements for the deployment of crisis remediation resources. Responsible for legal matters involving jail diversion programs implemented as an alternative to incarceration for vulnerable populations, such as those suffering with substance use disorder, mental illness, and chronic homelessness. Serve as a resource for Federal, State, and Local legislative and regulatory related matters and may directly interact with state and federal agencies. Analyze legislative and regulatory requirements and assist business units in their implementation. High level interaction with senior management and all levels of corporate personnel to obtain information and provides counsel regarding sensitive and complex legal issues. Independently manages complex projects and coordinates work assignments with the legal staff, to deliver timely results. Serves as a resource for management throughout the organization with respect to legal issues or concerns as they arise, including issues related to member services. Supports all aspects of PIHP and CMHSP operations, which may include provider contracting, provider disputes, provider and member appeals, claim investigations, or employer group contract issues. Serves as a resource for management throughout the organization and the provider network with respect to federal and state privacy laws and regulations, including HIPAA and 42 CFR part 2, business associates agreements and breach notification obligations. 5 years experience with a law firm and/or in-house position providing legal services for sophisticated/complex health care and corporate transactions desired. Graduation from an accredited law school is desired. Admission to practice before the Michigan Supreme Court and active membership in the State Bar of Michigan is desired.
