Senior Counsel The candidate reports to: AVP Commercial Litigation, Ag and Large Loss Practice Group. Independently provides expert advice and counsel on defending highly complex specialty practice legal matters across Nationwide’s Trial Division offices. Creates valuable risk management recommendations by identifying and assessing potential legal risks in the most significant or highly complex legal matters having the greatest potential for significant risk or exposure to the company. Focuses on providing input and execution of strategies and plans for defending suits in commercial specialty areas. Works with all NTD attorneys in assigned specialty practice areas; as matrix manager, works with Regional AVPs and MTAs to oversee attorney and paralegal performance. Works with Claims Technical teams on litigation resolution strategies; serves as point of contact for aligned Claims leaders (directors, managers) and develops and maintains relationships with these leaders. Provides subject matter expertise on significant, high-risk or highly complex legal matters with values typically in the $500,000 – $1,000,000 range or higher. Provides the high level of subject matter expertise for areas of legal specialty. Collaborates with Trial Attorneys to provide correct technical advice, litigation and resolution strategies to limit significant exposure to NTD (for legal malpractice), to Nationwide (Claims bad faith exposure) and the insured (Personal Liability and/or corporate liability in excess of policy limits. Actively identifies and logically assesses potential legal risks and exposure in specialty practice cases. Creates valuable risk management/mitigation recommendations leveraging sound risk assessment information to further defend the most complex cases. Analyzes and conferences cases scheduled for trial within identified exposure levels. Advises AVP of all high exposure litigation cases. Regularly interacts with senior NTD leaders and Claims leadership as point of contact regarding case strategies, exposures. Develops, maintains and promotes positive relationships with claims leaders; seeks feedback and addresses identified issues. Creates practical and effective solutions to the most complex legal issues; develops creative solutions to unique legal problems. Works with Claims Technical Teams on litigation resolution strategies; develops and maintains relationships with these teams and Claims leaders. May have contact with Nationwide member; may have interaction with other persons outside of the company. Takes the lead role advising in matters that are highly complex, significant or high-risk. Understands the business partner's position and needs. Keeps senior leaders and appropriate management of Company informed of case law and new legislation, as appropriate. Considers the long-term business and strategic consequences of possible outcomes. Delivers difficult messages or news, and challenges business partners when necessary; responds to challenges to advice and counsel directly and effectively. Works independently and collaborates to resolve highly complex legal issues. May have matrix management responsibility for a small group of lawyers within a specialized area of law. Serves as matrix manager for all attorneys in the specialty practice area (20 to 150 attorneys). With Regional AVP, hires commercial attorneys and paralegals and develops specialty practice onboarding. Provides input into performance for matrix relationship attorneys. Makes recommendations related to workflow and case organization; monitors inventory levels and works with leadership to redistribute cases as appropriate. Assesses legal technical skill and competency development training. Recommends and partners with regional leadership to provide training for claims, attorneys and paralegals. Promotes Best Practices/Best Process consistency; assists in monitoring Best Practice compliance. Participates in file audits and reviews. Drives improved performance and improved customer satisfaction. Performs other duties as assigned.
Qualification and Experience
The candidate should have JD degree from an accredited law school. Maintains an active license in one of the states in which NTD practices. 10 years’ legal experience; litigation experience preferred. Knowledge of PC insurance industry required. Willingness to manage performance in matrix reporting relationship is needed. Should have knowledgeable of laws, regulations and administrative processes associated with NTD litigation. Must have strong written, verbal communication and relationship skills. Strategic and analytical skills are needed.
