Chief Legal Counsel Duties: The candidate will serves as the executive legal policy maker for the Child Support Enforcement Division (CSE) overseeing CSE’s legal operations; and managing CSE’s Policy and Procedures unit, Special Litigation unit, the Problem Resolution Office, and the Criminal Justice Program. Provides guidance to CSE’s executive, management, and line staff; drafts and analyzes state and federal legislation affecting the child support program; provides procedures and policy directives; coordinates CSE’s actions on cases where customers have safety concerns; and coordinates outreach activity with incarcerated and paroled parents. As a member of CSE’s executive management team, the Chief Legal Counsel shares in the responsibility for moving CSE into the next generation of child support enforcement, by establishing strong collaborations and partnerships with other federal, state, and local agencies that share CSE's mission to promote responsible parenthood and self-sufficiency. Oversees the development of comprehensive child support enforcement legislation, regulations, policies and procedures, forms, and legal opinions to ensure compliance with federal and state mandates; as well as effective and accurate implementation of policy and procedures by other CSE units. Advises state and federal legislators and policy makers on proposed legislation, child support regulations, technical corrections, and new policy directions for the child support program. Designs and executes initiatives with partners in other government and community organizations; and troubleshoots issues that cross associate organizations including the Probate and Family Court, other state and federal child support agencies, the Department of Transitional Assistance, the Department of Public Health, the Department of Children and Families, and other public agencies or private sector partners. Functionally oversees CSE's legal operations, including activities associated with approximately 30,000 child support hearings annually; confers regularly with legal staff on agency initiatives and issues to ensure compliance with state and federal law, and effective business practices; and works with other child support senior staff to analyze problem areas, determine appropriate administrative solutions, implement change based on analyses, and develop recommendations for procedural, legislative, or judicial improvements. Participates in developing policies and annual business planning for CSE; providing input into setting program priorities and performance strategies; and participating in strategy sessions with senior managers, the Chief Justice of the Probate and Family Court and court administrators to ensure compliance with state and federal mandates, sound and consistent legal positions, and cost-effective child support administration. Provides legal counsel to other units within the Division, including Customer Service, Finance and the regional counsels; and determines litigation and appellate strategy for CSE in cases involving unusual or precedent setting facts or questions of law. Participates in negotiating and approving contracts, agreements, and Memoranda of Understanding between CSE and other governmental and private agencies; and monitoring compliance. Designs and delivers training on specific CSE policy and practice to CSE staff, judges, private attorneys, probation officers, and collaborating agencies at both the state and national levels. Within the oversight duties of the Policy and Procedures, Special Litigation, and Community Relations Units the Chief Legal Counsel is responsible for the following functions: Providing legal counsel to CSE staff on agency policies and initiatives and the resolution of child support issues; conducting legal research and drafting memoranda of law. Providing legal oversight of CSE's workgroups charged with developing implementation strategies for new initiatives. Developing procedures for the settlement of arrears in appropriate cases, and oversee implementation. Responding to correspondence received by Commissioner and Deputy Commissioner relating to legal and procedural issues connected with the administration of the child support enforcement program. Resolving cases involving complex issues, such as Worker's Compensation, bankruptcy, insurance liens, passport denial, bank levy and paternity. Overseeing CSE’s development of outreach materials, and may include directing the production and distribution of information (print and video) to support CSE’s mission. Overseeing compliance with the State Plan and serve as liaison to federal government on State Plan issues.

Qualification and Experience

Qualification: The candidate should have 6+ years of full-time or, equivalent part-time, professional, administrative, supervisory, or managerial experience in a particular specialty (i.e. scientific, professional, or technical) and must have current license and/or registration requirements established for the performance of the position, of which a1+ years must have been in a supervisory or managerial capacity or any equivalent combination of the required experience and substitutions below. A certificate in a relevant or related field is substituted for 1+ year of the required experience.A Bachelor’s degree in a related field is substituted for 2+ years of the required experience. A Graduate degree or higher in a related field is substituted for 3+ years of the required experience. A Doctorate degree in a related field is substituted for 4+ years of the required experience. Family Law Experience – Ability to provide guidance and direction on matters concerning family law is preferred. Must have communication Skills - Exceptional oral and written communication skills, including directing staff in a manner that enhances productivity and manifests excellence, effective listening techniques, strong negotiation/mediation ability and the capacity to build bridges with others to achieve shared goals.
