Attorney III - Office of Disciplinary Counsel The candidate performs professional legal work for the SC Department of Labor, Licensing and Regulation. Serves as a disciplinary attorney for SCDLLR and its components in routine to complex proceedings. Handles appeals to the Administrative Law Court (ALC) and on occasion to the Court of Appeals and Supreme Court. Appears before other such forums as required to execute legal functions. Performs extensive trial preparation, prepares witnesses, identifies gaps in evidence, organizes documents and demonstrative evidence for presentation, researches and responds to predictable legal issues, and advises law clerks and support staff on preparation and organization. Provides quality customer service. Maintains accurate, complete and updated files on agency case management system per ODC requirements. Employs case reports, calendars, dockets and other tools to plan, organize and manage case flow. Actively coordinates with support staff and supervisor to ensure that legal matters are resolved per ODC guidelines. Performs substantive legal research into various aspects of the professional practice relating to disciplinary actions. Generates and responds to legal motions, orders and other preliminary and post-trial legal actions. Negotiates and prepares settlement documents to resolve disciplinary matters and presents negotiated settlements to boards for approval. Assists investigators and administrators to achieve complete investigations of cases. Assesses the legal sufficiency of requests for temporary suspension orders, orders for evaluation, injunctions and other preliminary actions. Prepares required legal documents and defends board's position before appropriate forum. Monitors law clerk and support staff functions. Other duties as assigned. Should preferably have JD degree or its equivalent from an accredited law school and at least three years of experience as a practicing attorney. A member of the SC Bar in good standing and completion of the 403 requirements.
