Attorney The candidate will oversight and coordinator of all division legal matters, with emphasis on land acquisition. Provide legal advice related to land acquisition and development, including drafting contracts and related documents, reviewing title, working with title company, working with municipalities and special districts, handling closings, consulting with and coordinating outside counsel, as necessary. Review and revise homebuyer contract documents; advise regarding RESPA issues and other issues. Handle customer disputes; coordinate outside counsel as necessary. Review and revise homeowner association documents and provide advice on homeowner association issues. Assist in managing division litigation, including coordination with outside counsel regarding active and potential litigation matters, provide documents and information pertinent to active or potential litigation, attend hearings, settlement conferences and related proceedings. Review marketing contract and programs; draft documentation as necessary. Review and revise subcontractor contract documents, handle disputes. Review safety programs, review and revise manual and written policies, handle safety issues including OSHA. Provide advice, regarding employment matters and issues; conduct manager training regarding employment policies and practices; assist in drafting job descriptions; handle disputes, draft policies, involve outside counsel as necessary. Provide advice regarding legal issues in construction and warranty. Provide advice regarding various other division matters. This position may or not may manage an employee. Carries out supervisory responsibilities in accordance with the organization's policies and applicable laws. Responsibilities include interviewing, hiring, and training employees; planning, assigning, and directing work; appraising performance; rewarding and disciplining employees; addressing complaints and resolving problems. Should have Juris Doctor Degree (J.D.). Ability to read, analyze, and interpret the most complex documents. Ability to respond effectively to the most sensitive inquiries or complaints. Ability to write speeches and articles using original or innovative techniques or style. Ability to make effective and persuasive speeches and presentations on controversial or complex topics to top management, public groups, and/or boards of directors. Ability to work with mathematical concepts such as probability and statistical inference, and fundamentals of plane and solid geometry and trigonometry. Ability to apply concepts such as fractions, percentages, ratios, and proportions to practical situations. Ability to define problems, collect data, establish facts, and draw valid conclusions. Ability to interpret an extensive variety of technical instructions in mathematical or diagram form and deal with several abstract and concrete variables.
