Associate Counsel Level B, Labor Relations Duties: Under direction of the General Counsel provides counsel and recommendations on major matters or those without precedent involving legal rights of the Corporation on maintenance of operations within the limits prescribed by law. Covers major issues of a legal nature involving activities performed by the Corporation, employees, directors, officers or organizational units arising between corporation, patients, suppliers, agents of the Corporation, community, outside parties, and governmental organizations, agencies and entities. In the Office of Labor Relations Counsel, under direction of Labor Relations Counsel guides staff, makes recommendations, renders opinions and findings, and participates in representations, acts as an Assistant to Counsel, interprets and renders opinions on labor relations law, personnel rules and regulations, labor contracts and labor legislation that may effect the conduct of the Corporation’s personnel and labor relations policies, plans and programs and their administration and implementation. Advise Health Care System Administrators on questions of law, statutes, administrative codes, regulations and rules affecting the operation of the Health Care System on matters pertaining to labor relations, employee relations, personnel administration, unfair labor practice and Civil Service Law. Advises and represents the Health Care System in labor arbitration proceedings, disciplinary litigations before the Office of Administrative Trials and Hearings and in other administrative or quasijudicial proceedings arising out of labor and employee relations disputes. Participates in review of implementation of programs, practices and procedures of personnel, employee and labor relations practices to ensure compliance with the general body of labor and labor relations law, their statutes, administrative codes and regulations. "Provide legal advice and counsel to Health Care System Administrators on review of major System-wide policies. Represents Health Care System facilities in various administrative proceedings. Participates in conferences and meetings regarding legal interpretation and meaning of the general body of law that may affect the proposals and intent of parties and assures that agreements negotiated are consistent with labor legislation, statutes, administration codes, rules and regulations. Reviews pending legislation, including court, administrative decisions and regulations, and prepares comments and recommendations regarding proposed legislation and rulings.
Qualification and Experience
Qualifications: A baccalaureate degree or equivalent, and LLB or JD Degree from an accredited School of Law; and admission to New York State Bar; and 3 years of experience and background in the practice of law subsequent to admission to the Bar in matters of litigation, negligence, corporate law, contracts, real estate, labor relations, labor law and employee relations, or2 years of experience and background in the practice of law subsequent to admission to the Bar in matters of litigation, negligence, corporate law, contracts, real estate, labor relations, employment law and employee relations, with 2 years of progressively responsible experience in a professional or managerial capacity in respective fields applicable to the general body of law, specialties or practice.
