ProfileManaging Attorney, Claims Defense The candidate manages and directs the defense of lawsuits and claim litigation against Firm General Insurance Co and/or company policyholders to ensure a satisfactory conclusion according to the terms of the policies issues and to achieve the best possible case position within the limits prescribed by law. Monitors the company’s litigation activities and advise Claim Litigation Handlers as well as outside defense or coverage counsel: oversees legal process to ensure overall quality concerning case handling. Promotes effective communication among and between Claims Litigation Handlers, Management and Staff Defense Counsel. Develops and implements Firm General Insurance Company’s policies and procedures for Best Practice Litigation handling. Completes annual reviews of randomly selected case files. Keeps apprised of changes in tort and contract law, as well as recent court decisions, that may impact the company’s business practices, and appraise staff of such changes and court decisions. Recommends department plans and budgets, and conducts activities according to the approved company and departmental plans and budgets; consults in a manner to manage and control expenses. Develops and implements short and long range objectives consistent with Firm General Insurance Co’s goals, guideline, and programs. Oversees and directs activities of Staff Defense Counsel and outside counsel, utilizing resources effectively to meet department goals and objectives. Partners with Claims Management to interview and select outside defense counsel for litigation defense; develop a process to monitor defense counsel performance. Manages Staff Defense Counsel and ensures execution against established objectives. Responsible for the hiring, training and supervision of Staff Defense Counsel.
Qualification and Experience
The candidate should have Juris Doctorate (JD) degree from an ABA approved school, and member in good standing with the State Bar of California. Must have 5-7 years of experience in litigation defense in a corporate or law firm environment. Strong knowledge of insurance laws and regulations is essential. Excellent verbal and written communication skill is essential. Strong knowledge of Microsoft applications (Word, Excel, PowerPoint) is essential. Expertise in insurance claims litigation; must be capable of managing any case to conclusion by jury trial is essential.
