Senior Director, Global Privacy Counsel Responsibilities: Lead and develop the Legal Privacy team, which is comprised of legal professionals across multiple jurisdictions – San Jose, New York, United Kingdom, Luxembourg and China. Coordinate and supervise a wide variety of legal activities related to all aspects of Company’s privacy and data security obligations globally, which include: M&A diligence and integration, contract negotiation, product development, marketing and mar-tech initiatives, evaluation of data processing activities, data incident and breach management, analysis and implementation of global privacy and data security requirements, Serve as a key subject matter expert and advisor to Company lawyers and business units on privacy and data protection issues in commercial negotiations. Advise Company senior leaders, including the Chief Privacy Officer, on strategic matters involving the processing of personal data to help maintain compliant privacy and data protection practices across the Enterprise, while enabling business initiatives and helping to maintain Company’s reputation as a trusted company for various external stakeholders – customers, partners and regulators. Develop training for legal colleagues to help them advise their clients regarding privacy and data protection issues, as well as develop and maintain guidelines, playbooks, templated terms, and other resources. Coordinate with regional lawyers to evaluate and, where appropriate, help design products, services and technologies for compliance with local data privacy regulations, as well as help to negotiate various agreements. Collaborate with Legal Privacy teammates and Compliance colleagues, the Global Privacy Office and Company’s International Data Protection Officer (DPO) to develop, enhance and implement the Company Global Privacy Framework in markets where Company operates. Advise on new and emerging legal and regulatory developments impacting data privacy and data security, including identifying trends and potential impacts on business activities. Understand and advise on the privacy and data protection legal requirements applicable to complex data flows across the data lifecycle. Collaborate and coordinate with government relations teams to proactively monitor and review privacy and data-protection related legislation in order to help ensure accurate and up-to-date inventories of all legal obligations.

Qualification and Experience

Experience: Deep, demonstrable privacy, data protection, and program management skills and expertise, with an emphasis on data security and/or financial privacy laws. Specific experience with privacy and data protection laws, including GLBA, CCPA, LGPD, PDPA, APPs, PIPEDA, GDPR, CAN-SPAM, HIPAA, e-Privacy Directive, PCI-DSS, NY DFS 500 Regulations, and other applicable laws is required. Experience providing risk-based, pragmatic and commercially focused legal advice on privacy and data protection issues. In-depth knowledge of cutting-edge IT, web, mobile, and payment ecosystem technologies (especially those used in the collection, storage and analysis of data) and their privacy and data security implications. Familiarity with, and strong interest in, financial services technology, mobile and alternative payments, as well as emerging technology. Ability to thrive in a fast-paced environment and to tolerate change and ambiguity. Global thinker and demonstrated collaborator, who displays sound and pragmatic legal and business judgment in providing practical advice to clients on privacy and data protection issues. Ability to translate legal advice into actionable policies, processes and programs that enable business objectives. Facility with a team-based approach to subject matter management and knowledge sharing, and comfort with a flexible, agile environment that emphasizes collaboration and team performance over management hierarchy. Demonstrated ability (i) to effectively coach and mentor others (including non-attorneys); (ii) to work autonomously, as well as part of a team; and (iii) to work with a sense of humor and resiliency, especially under tight deadlines and while managing multiple priorities. 12 or more years of experience practicing either in-house (or in an equivalent setting) and/or at a reputable law firm. Juris Doctorate or equivalent degree. Admitted to a state bar. Exceptional writing skills, with attention to detail and ability to generate creative, original drafting and documents. Excellent communication and presentation skills; ability to communicate and help non-experts understand applicable regulations and requirements. Experience advising clients in the financial services, mobile payments, internet and technology industries preferred. Relevant technical certifications, such as a Certified Information Privacy Professional (CIPP) or other relevant certifications preferred.
