Attorney III
The candidate drafts, reviews and evaluates legal documents, pleadings, regulations, policies, legislation and legal precedents to determine impact on the agency or client. •Represents the agency or client in administrative proceedings and trial courts and may assist in appellate proceedings and negotiate routine settlements. Conducts discovery and interviews witnesses, researches and analyzes a variety of issues and proposes strategy on specific matters. Work preclude management from assigning other duties which are reasonably within the scope of duties. Serves in an advisory role as legal counsel to the elected commissioners comprising the Commission. Will be responsible for a caseload of pending adjudicative and rulemaking matters requiring interaction with hearing examiners, analyzing evidence and legal arguments, advising the commissioners and drafting commission orders and rules, retaining and interacting with technical advisors to provide expert advice to the commissioners, and representing the Commission in any appeals of the Commission's Orders before the New Mexico Supreme Court and US District and Circuit Courts. Also directly prepare and conduct administrative hearings on various issues within the Commission's jurisdiction. Analyze and advise the commission on compliance with various statutory and administrative requirements including the Open Meetings Act, State Records Act, and Inspection of Public Records Act. Appear before the New Mexico Legislature concerning proposed legislation and agency budgetary matters. Should have Juris Doctorate degree from an accredited school of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Experience: utility / administrative law experience; litigation experience; experience working for elected officials/ boards/ commissions; general counsel experience; appellate practice experience.
