AVP Assistant General Counsel - Litigation
Responsibilities: Provide strategic advice on the most complex legal and/or contract scenarios; serve as point of escalation and key partner to internal clients, including senior and executive leadership across all functions of Prime. Develop, review and maintain legal policies and operating procedures to ensure compliance with relevant laws and regulations; lead the socialization, implementation, and on-going review of policies and practices to drive consistency, maintain relevance, and build a culture of compliance by design . Direct, perform research, and draft litigation management and/or transactional work in support of assigned business area. Oversee the identification, development, facilitation and evaluation of functional legal training for the business. If assigned to PBM Contracting, lead the organization through the negotiation, standardization, and administration of sophisticated commercial agreements; develop and socialize standard positioning and/or contract deviation opportunities in partnership with senior and executive leadership, and drive effective contracting practices for all aspects of client agreements (new sales, renewals, amendments etc.). If assigned to the litigation function, oversee Prime’s Records and Information Management (RIM) program, lead the development and administration of the eDiscovery platform, support efforts by Prime’s employment attorney, and lead Prime’s litigation management efforts. Manage department budget, staffing, performance and development, and consistently demonstrate Prime’s leadership expectations during interactions with direct reports, cross functional and external stakeholders. Other duties as assigned.

Qualification and Experience

Qualifications: JD degree and current state attorney’s license with the ability to secure a Minnesota license within 6 months in the job. 12 years of experience practicing as an attorney, with 5 years of experience representing managed care companies or other health care clients. If supporting litigation, 5 years of experience leading dispute resolution, handling government audits/investigations, managing complex litigation and employment-related matters, and managing outside counsel relations and budgets. If supporting PBM contracting, 5 years of experience leading complex commercial agreement negotiations and processes. 8 years of leadership/management experience. Must be eligible to work in the United States without need for work visa or residency sponsorship. Excellent organization and analytical skills and strong legal project management and facilitation skills. Strong interpersonal skills, sound judgment, excellent oral and written communication skills, and an adaptable, cooperative and persuasive approach. Demonstrated ability to work both independently and collaboratively, provide leadership, influence organizational behavior, and create alignment across disparate groups. Demonstrated ability to influence business clients and effect necessary change in policies or behaviors. Financial acumen and familiarity with common business finance principles. Demonstrated ability to distill complex concepts or situations into concise and compelling communications. Demonstrated expertise within one or more practice areas required by Prime’s business needs. Preferred: Demonstrated experience in federal laws and regulations such as HIPAA, Anti-Kickback, and False Claims Act, and those related to pharmacy benefit management and the managed care industry.
