Paralegal Responsibilities: Process physician agreement requests by drafting and reviewing. Develop and maintain physician agreement templates for use by the Legal Department (both the paralegals and attorneys). Manage incoming agreement requests by reviewing the request in I:Manage and coordinating a response from the Legal Dept. Ensure that fair market value documentation is obtained and appropriate for physician agreements. Prepare physician agreements based on legal standards and in consultation with Contract Managers and in investigating and documenting stakeholders on contract requirements. Serve as a central contact person for questions about physician agreements from Contract Managers and operations staff. Assist attorneys in identifying areas of legal risk related to the federal Stark rules when processing and reviewing physician agreement requests. Assist in investigating and documenting Stark compliance issues. In conjunction with Contract Managers, work with electronic database of physician and other agreements. Assist in the development of contract management workflows to process both incoming physician agreement requests and follow up reviews of active agreements. Train the Legal Secretary and other members of the Dept on how to use the database. Prepare non-physician contracts, templates and other legal documents During contract requests and audits, the Paralegal will meet independently with Legal Dept staff, and, as necessary, business operations and/or the outside party to the contract to resolve contract issues. The Paralegal can perform this work independently and involve Legal Dept staff as needed to resolve legal issues. Review vendor, Business Associate, Non-Disclosure contracts and other contracts to identify legal issues prior to attorney involvement. Create, organize and manage contract templates for use by the Legal Dept to gain better efficiency. Prepare legal memos, correspondence, etc. on various topics. Identify opportunities for standardization and implement efficiencies in dept operations. Identify and analyze legal issues and conduct legal research Prepare legal position statements for attorney review pertaining to policies, operational practices and other transactions. Participate in the development of policies and procedures. Interpret and apply legal rules, regulations, policies and procedures. Conduct routine and specific legal and factual research and data compilation. Perform records research Analyze legal documents. Coordinate information gathering and review for due diligence Perform issue analysis and identify alternative solutions. Serve as a point of contact for internal and external customers when attorneys are unavailable or to determine which attorney to send the matter to. Assist with the upkeep of the Legal Dept website and create content for the website. Work cooperatively with the Legal Secretary on projects and file organization. Assist with other projects as requested by the attorneys.
Qualification and Experience
Qualifications: Four-year degree required or significant and relevant experience working as a paralegal. Previous experience as a Contract Specialist, Paralegal or equivalent position working for a business or law firm in a corporate or health care related area. Preferred: Four-year degree in a legal, business or health care related field. Paralegal Certificate. Knowledge and experience of health care rules, regulations and topics.
