Job Overview:

A law firm in Madison, WI, seeks a highly skilled and experienced Senior Advertising Marketing and Promotions Associate Attorney. The ideal candidate will possess extensive experience in advertising law, consumer protection law, and marketing transactions. This role demands expertise in drafting and negotiating various marketing-related agreements, providing legal counsel on compliance issues, and handling disputes related to advertising practices.

Duties and Responsibilities:

• Draft and negotiate ad agency agreements, influencer contracts, celebrity endorsement, sponsorship agreements, and online media buying contracts.
• Review and analyze advertising copy to ensure compliance with false advertising regulations, claim substantiation, intellectual property rights, and right of publicity issues.
• Provide legal counsel on contest and sweepstakes compliance, including drafting and reviewing official rules and ensuring adherence to relevant regulations.
• Advise clients on price advertising practices, recurring subscription programs, and loyalty/rewards programs.
• Handle disputes about false advertising, unfair competition, and National Advertising Division matters.
• Collaborate with internal teams and clients to address complex advertising and marketing issues.
• Maintain up-to-date knowledge of industry trends, legal developments, and advertising and marketing law regulatory changes.

Requirements:

• Minimum of 7 years of relevant experience in advertising law, consumer protection law, and marketing transactions.
• Proven track record of drafting and negotiating various marketing and promotion agreements.
• Experience with false advertising, unfair competition, and National Advertising Division dispute work is a plus.
• Strong attention to detail and working effectively in a collaborative team environment.
• Excellent academic credentials and outstanding legal writing and communication skills.
• Experience working in a large or medium law firm setting is preferred.

Education:

• Juris Doctor (JD) degree from an accredited law school.

Certifications:

• Admission to the state bar where the firm is located (or eligibility for admission).

Skills:

• Deep understanding of advertising and marketing law, including compliance and regulatory issues.
• Expertise in drafting, negotiating, and reviewing complex agreements related to marketing and promotions.
• Strong analytical and problem-solving skills with the ability to manage multiple tasks simultaneously.
• Exceptional written and verbal communication skills.
• Ability to work independently and as part of a team.
• Proven track record of providing strategic legal advice and counsel.
