Deputy District Attorney II The candidate will perform trials, motions, file cases and other professional legal work connected with enforcement of criminal law. Will study, interpret and apply statutes, ordinances, court decisions and other legal authorities in the preparation of cases, opinion and briefs. Negotiate and confer with the judges and defense attorneys on appropriate disposition of cases. Perform a wide variety of legal research and prepare appeals, writs and other legal documents. Interview and examine witnesses. Perform varied professional legal work in the preparation of legal opinions, rendering of legal counsel to County departments and districts; enforcement of criminal, civil, or child support establishment and enforcement laws; representation of the public, county or individuals in court; defense of persons accused of crimes; preparation of legal documents; and to do other work as required. Receive complaints, evaluate evidence and determine the nature of the crime and the justification for prosecution; prepare and process misdemeanor and felony cases in all courts; confer with judges and defense attorneys; prepare briefs and other legal documentation; and confer with various law enforcement agencies and the public. Conduct State Fair Hearings, civil contempt actions and complex enforcement cases involving forensic analysis of individual and business financial records, bankruptcy cases, writs and appeals in State and Federal courts. Prepare and conduct trial defenses for clients accused of misdemeanor and felony crimes; negotiate with judges and prosecuting attorneys on appropriate disposition of cases; prepare appeals, writs and other legal documents on the behalf of defendants; decide on and make appropriate legal motions and pleas; and represent persons involved in conservatorship and civil contempt proceedings. Confer with and advise county, district officers and employees on legal questions; prepare formal opinions as to the legality of action; draft ordinances, resolutions, contracts, leases, conveyances and other legal documents; prepare pleadings and other papers in connection with law suits, trials, hearings and other legal proceedings in which the County is involved; and conduct condemnation, damage or other legal litigation involving the County in Superior, State and Federal courts. Perform a wide variety of legal research and prepares briefs. Prepare correspondence and reports. Interview and examine witnesses in.

Qualification and Experience

The candidate should have active membership in the State Bar of California. Must have 1 year of experience as an attorney in the practice of civil, governmental, criminal or child support establishment and enforcement law. Should preferably have 5+ years of experience as an attorney in the practice of civil, governmental or criminal law with experience in litigation and trial of civil matters that include allegation of Fraud. Significant jury trial experience such as prosecution and/or trial of five or more complex civil cases or complex criminal jury trials is desired. Should have knowledge of: the duties, powers, limitations and responsibilities of the District Attorney's, County Counsel's, Child Support Services' or Public Defender's Offices; the organization, powers and limitations of county government functions and of the California Constitution; Federal and California statutes and regulations pertaining to IV-D child support agencies; Legal principles and their application; rules of evidence and conduct of court proceedings; Penal Code of California and/or California civil and legislative law; child support establishment and enforcement law, pleading and practice; legal research methods; and civil legal processes. Must have ability to: prepare, present and conduct cases of law in court; prepare legal documents such as pleadings, briefs and depositions; analyze legal problems and apply legal principles and practices; present statements, of fact, law and argument clearly and logically in written and oral form; analyze and draft ordinances and other regulations; effectively perform legal research; work independently on all but the most complex assignments; prepare legal documents such as pleadings, briefs and depositions; and conduct criminal or civil court trials, jury trials and hearings. Should preferably have: thorough knowledge of legal principles and their application; rules of evidence and the conduct of court proceedings; and the laws of California.
