Assistant City Attorney Duties: Acting as general counsel; representing APD in the matter of United States v. City of Albuquerque, 14-cv-1025; reviewing and providing advice regarding policies, trainings and contracts; reviewing uses of force; representing APD or officers in legal proceedings, including motions, responses to subpoenas, and requests for blood draws; drafting legal opinions; reviewing and drafting legislation, ordinances, and executive/administrative instructions; providing counsel on Inspection of Public Records Act requests and other open government issues; and providing general advice and counsel on day-to-day operations. Attention to detail and strong writing skills are essential. Additional duties and representation of other City Departments may be assigned. Preferences include: Broad experience in both civil and criminal law; five (5)+ years’ experience; experience in drafting policies; experience in developing curricula; experience in drafting and reviewing contracts; and addressing evidentiary issues. Must be admitted to the practice of law in New Mexico and be an active member of the Bar in good standing.
Qualification and Experience
Requirements: JD Degree from an accredited law school recognized by the American Bar Association; and Must be an active member of the State Bar of New Mexico in good standing, or be able to become licensed in New Mexico within 3 months of hire. Preferred Knowledge: State and federal laws and constitutional provisions affecting police department activities. Experience in the practice of municipal law; municipal, local or state government; and governmental affairs. Organization, duties, powers, limitations and authority of city government, the city attorney’s office and APD. Principles of curriculum development and adult education. Established precedents and sources of legal reference applicable to police department activities. Modern office procedures, methods and equipment including computers. Methods and techniques of legal research. Principles of project development and management, business letter writing, report and proposal preparation. Supervisory experience. Preferred Skills And Ability: Organize, interpret and apply legal principles and knowledge of complex legal problems. Legal research, analysis and writing. Interpret and apply federal, state and local policies, procedures, laws and regulations to police department activities. Conduct research on complex legal problems and prepare sound legal opinions related to police department activities and constitutional policing. Recommend and implement goals, objectives, and practices for providing effective and efficient solutions to legal issues confronting the functioning of a police department. Exercise sound judgment; work cooperatively with others; and prepare clear and concise oral and written correspondence and presentations. Select, supervise, train, coordinate and direct work, and evaluate staff. Evaluate and provide recommendations on programs, policies, and operational needs of the police department. Communicate clearly and concisely. Work independently in the absence of supervision. Establish and maintain effective working relationships with key APD personnel, community takeholders, external agencies, and community members contacted in the course of work. Perform the essential functions of the job with or without reasonable accommodation.
