Public Defender 2 The candidate advocates for indigent clients in assigned cases at every stage of the criminal justice system in more difficult cases. Appears and advocates in court at pre-trial hearings, bench or jury trials, sentencings, and other court hearings. Negotiates plea bargains, dismissals, or other disposition of assigned cases with prosecuting attorneys. Investigates facts and prepares defense for assigned cases to determine the merits of cases and appropriate course of action in more difficult cases. Interviews, confers and advises clients on merits of appropriate course of actions, including seeking a dismissal, plea, or trial. Will locate and interview witnesses. Conducts discovery, including depositions. Plans case strategy and prepares for trial. Maintains appropriate communication with client about status of the case and answers client questions. May direct work of investigators consistent with internal office policies. Identifies potential legal issues to advance client's case, research applicable law, and draft appropriate motions and briefs in more difficult cases. Prepares by typing and printing various legal documents, including written arraignments, written guilty pleases, motions, briefs, letters and other documents. Maintain client case files, prepares public defender time reports to the court, and closes files consistent with office policies. Performs journey?level professional legal work related to the representation of indigent clients and juveniles in cases where the local Public Defender has been appointed as counsel; performs related work as required. Participates in the investigation and preparation of a defense for assigned cases to obtain facts in determining the merits of cases and appropriate courses of action. Prepares drafts of pleadings, motions, supporting affidavits, letters, and briefs. Advocates in assigned cases at every stage of the criminal justice system through resolution in the pre? trial process, plea bargaining process, trial, verdict, and sentencing by providing legal counsel and advice, interviewing and selecting appropriate witnesses, preparing witnesses to give testimony, presenting argument in court, and conducting direct and cross examination of witnesses. Negotiates plea bargains, dismissals, or other dispositions of assigned cases with prosecuting attorneys or other interested parties. If assigned to the central administrative office, reviews and adjudicates indigent defense attorney fee claims and takes appropriate action in each case; applies pertinent statutes and rules; investigates and responds to inquiries and complaints; represents the State Public Defender’s Office in administrative hearings and court by raising motions, objections, and arguments in fee claim litigation.

Qualification and Experience

The candidate must meet one of the following minimum requirements to qualify for positions in this job classification:
Graduation from an accredited law school, possession of a current license to practice law in the State of Iowa, and experience equal to 2 years of full-time work in professional legal criminal trial advocacy or prosecution. Current, continuous experience in the state executive branch that includes eighteen months of full time work as a Public Defender 1.
Knowledge: Law and Government – Laws, legal codes, court procedures, precedents, government regulations, executive orders, agency rules, and the democratic political process. English Language – The structure and content of the English language, including the meaning and spelling of words, rules of composition, and grammar. Customer Service – Principles and processes for providing customer services, including customer needs assessment, meeting quality standards for services, and evaluating customer satisfaction.

Oral Comprehension – Listen to and understand information and ideas presented through spoken words and sentences. Written Expression – Communicate information and ideas in writing so others will understand. Written Comprehension – Read and understand information and ideas presented in writing. Inductive Reasoning – Combine pieces of information to form general rules or conclusions.
