Attorney Advisor - CT 14 The candidate renders written or oral legal advice on assigned projects with respect to the relevant provisions of the Act and the Commission’s regulations, and other statutes, regulations, judicial decisions, and legal opinions that are pertinent. Advice addresses complex issues, and project deliverables include interpretations and application of the Act and the Commission’s regulations, as well as advice regarding the application of federal and local laws and regulations. Advises on legal and technical issues addressed by the R&C Branch, including matters applicable to registration and compliance with business conduct standards and requirements governing non-financial reporting and recordkeeping of market participants. Develops regulations, orders, guidance, legal analyses, and other regulatory approaches applicable to foreign swaps, futures, and options, and coordinates on matters and issues concerning compliance requirements with other Commission offices/divisions and federal and state regulatory authorities. Participates in the review of the National Futures Association’s (NFA) administration of the Commission’s registration program as delegated to it, along with the registration and compliance related rules submitted by NFA. Participates in reviews of market participants to determine their compliance with Commission regulations applicable to registration, business conduct standards, and non-financial reporting and recordkeeping requirements. May also be assigned to work with or lead a team on a particular project with staff members of other Branches of the Division, and/or with staff members of other Commission divisions and offices.
Qualification and Experience
The candidate must be a member of the Bar. Should have Currently an active member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico. Should have successful completion of a full course of study (JD) in a school of law accredited by the American Bar Association (ABA). CT-14: Candidates with a law degree (J.D. or equivalent) and bar membership and 4 years of relevant legal experience after completion of law school. At least one year of this experience must have been at a level of responsibility and difficulty equivalent to at least the GS/CT-13 level in the Federal Service. Should preferable have Experience providing technical advice and guidance to registrants and other market participants on a broad range of compliance issues. should preferable have experience with day-to-day interactions with stake holders on issues facing intermediaries such as requests for interpretive guidance and self-reported non-compliance matters. Experience in the preparation of regulations, advisories, and no action letters is desired. Knowledge of swap and commodities markets, over the counter swaps, financial markets generally, corporate law, and general administrative law is desired. Should preferable have Knowledge of, and experience with interpreting and providing advice on, regulations applicable to registration and compliance for market participants registered with the Commission. Must have demonstrated skill in research, analysis and technical writing of sophisticated legal issues, as well as excellent oral communication skills.
