Associate General Counsel
Responsibilities: Provide legal advice and services on issues concerning the rights, obligations, risks, and privileges of the organization. Protect the organization's rights in contract negotiations, settlements, and litigation. Acquire deep knowledge of the industry and the specific business practices of the company so as to best advise senior business leaders. Manage all aspects of affirmative and defensive litigation and arbitrations involving the company. Provide legal counsel in connection with internal investigations and responses to government inquiries. Provide legal advice on complex and sensitive matters regarding various laws and regulations applicable to health care. Help establish and implement creative and strategic initiatives that support the company’s internal and external stakeholders.
Qualification and ExperienceQualifications: Juris Doctorate Degree. 4+ years of legal experience with a law firm, in-house legal department, judicial clerkship, and/or government office. Experience managing investigations and drafting complaints/demands in courts and arbitration forums. Experience with complex civil cases for plaintiffs and defendants in Federal District Courts, including class action matters. Well-developed written and verbal communications skills. Excellent presentation skills. Ability to build and maintain rapport with superiors, peers, subordinates, and external company contacts. Experience interacting with regulatory and law enforcement agencies is preferred. A significant trial, arbitration, and negotiation experience are desired. Knowledge of health care and/or regulatory law is a plus. Familiarity with False Claims Act, Anti-Kickback Statute, state consumer protection and deceptive trade practices laws, Stark Law, HIPAA, ERISA, and various other healthcare laws and regulations, as well as Medicare, Medicaid, and commercial insurance plans are desired. Understanding of health care benefit coverage and medical policy development is preferred. Solid understanding of health insurance and/or managed care industry. Solid understanding of business, accounting and finance topics. Proven success in collaborating across a matrixed business and legal environment. Ability to evaluate and determine the appropriate legal course of action to meet business unit needs.
