Attorney Iii The candidate under the general direction of the Director of the Department of Industrial Relations and the CEA, works closely with Attorney IV and acts as legal counsel on the most complex and sensitive matters relating to the Department. The Attorney III exercises broad discretion and acts with great independence in providing legal representation and counsel and will perform the following duties: Assist the Attorney IV in preparing and representing DIR in special lien proceedings before the WCAB. Coordinates court action with claims administrators to remove identified liens from system. Coordinates with the Division of Workers’ Compensation (DWC), and outside law enforcement agencies. Collect and analyzes data, court documents relating to workers compensation fraud and potential basis for medical provider suspension. Assist the Attorney IV in preparing and issue order to show cause notices. Assists the Attorney IV in preparation for suspension hearings including gathering necessary evidence. If necessary, represents the Director in hearings and present evidence. Calls and examines witnesses, introduces exhibits, cross-examines opposing witnesses, rebuts evidence. Works with the Attorney IV and DWC Chief Judge in preparation for lien consolidation proceedings, including gathering necessary evidence. If necessary, represents the Director in hearings and present evidence. Calls and examines witnesses, introduces exhibits, cross-examines opposing witnesses, rebuts evidence. Performs a variety of other highly sensitive and/or complex legal duties requiring a high level of skill, judgment, and diplomacy.
