Counsel II The candidate under the direction of the General Counsel, provides legal advice and guidance on contracting and procurement issues at EEA, with an emphasis on information technology (IT) contracting. In consultation with the General Counsel, the Counsel II will assist in advising a variety of staff, including EEAâ€™s Chief Information Officer (CIO), executive leaders, EEAâ€™s grant-making divisions, and staff within EEAâ€™s constituent agencies. The Counsel II must become familiar with all rules and regulations applicable to public contracting and procurements for the Commonwealth, including all rules, regulations and guidance issued by the Operational Services Division, the Office of the Comptroller, and the Executive Office of Technology Services and Security. General familiarity with IT-related contracting issues, such as cloud computing, privacy and electronic records management, IT security, and software licensing and other intellectual property issues, is preferred. The Counsel II will be expected to review and advise on all contracts or procurements proposed by EEA, including requests for proposals (RFPs), proposed grants, and IT and other related contracts. In addition to contracts and procurement, the Counsel II will serve as the primary liaison within the Office of the General Counsel for a variety of compliance matters, including public records compliance, internal and external audits, document retention and management functions, open meeting laws, and the development of policies and procedures related to internal governance matters. Depending on interest and experience, the Counsel II may be asked to advise on select employment law matters, including representation of EEA and its agencies before administrative bodies such as the Civil Service Commission and the Massachusetts Commission Against Discrimination. Must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and 3 years of full-time, or equivalent part-time, professional experience in the practice of law.
