Roles and Responsibilities:

Negotiates complex contracts required to implement major capital investment projects.
Drafts and develops agreements with commuter and freight railroads, public utilities, state and local agencies, and other third parties as required to carry out the work of capital projects.
Evaluates, analyzes, and ensures compliance with State and Federal statutory requirements affecting capital projects.
Assists and coordinates the negotiation of Rights-of-Way (ROW) and railroad acquisitions and potential condemnation of property for use by NJ TRANSIT
Reviews and negotiates contract terms including environmental liability, indemnification and insurance issues between third parties, including other railroads, public utilities, municipalities and other transportation agencies.
Collaborates with the Risk Management, Procurement, Real Estate, Environmental and legal liaisons within and outside NJ TRANSIT on behalf of Capital Programs to implement capital projects.
Assists in the formulation of RFP provisions for design and construction contracts including the scope and technical approaches necessary for the design, construction and ROW acquisition for capital projects.
Prepares materials for training sessions for NJ TRANSIT staff on contracts, environmental matters, real estate and title issues, indemnification, etc.
Reviews, negotiates, and prepare written recommendations to Senior Management on potential claims prevention and conflict resolution regarding capital projects.
Fills in for Director of Contracts and Claims in absence and assists with special projects and reporting as required.
Performs other duties as assigned.

This Position Supervises:

Contracts and Claims Administrator

Education, Experience and Qualifications:

Baccalaureate Degree in Business Administration, Real Estate, or related area or equivalent and six (6) years of applied experience in the drafting and negotiation of public construction, real estate and/or railroad agreements.
The ability to analyze and interpret complex contracts, agreements, statutes and regulations is required.
Juris Doctor is strongly preferred and may be substituted for three (3) years of applied experience.

Knowledge and Skills:

Experience with Microsoft Office include Word, PowerPoint, Excel, Outlook, and Teams is required.
Strong verbal and written communication are required, as well as the ability to organize and prioritize multiple tasks.
